AND RELATED EXPENDITURES AND FEES; ADDING
SECT=oN5 2.646 AND 2.648 To THE EUGENE CODE,
1971; AND DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
For many years the Eugene-Springfield area, has been provided
ambulance service by a licensed ambulance operator.
Should the private ambulance operator fail to perform this
essential emergency service, the community would be without the ser-
vice and the public health, safety and welfare gravely affected.
As part of its emergency preparedness efforts, the City Council
finds and determines that the City Manager should be granted author-
ity to provide ambulance service, establish fees, and to make expen-
ditures therefor when certain conditions exist which are detrimental
to the public health, safety and welfare.
THE CITY OF EUGENE DOES ORDAIN AS FoLLOwS:
Section 1. The following sections are hereby added to the
Eugene Code, 1971, to provide:
2.606 Ambulance Service.
~l~ As used in sections 2.646 and 2.608 of this chap-
ter, "ambulance service" means provi,d~,ng emergency transporta-
tion of persons suffering from illness, injury or disability
inside and outside the city limits.
4.2} In the event an ambulance operator's license is
suspended or revoked under chapter 3 of this code or it is
determined by the city manager that the community is or will

• imminently be without ambulance service, the city manager is
authorized to expend public funds from whatever source to pro-
vide ambulance service to the cor~n~unity until directed b the

council to cease the expenditures, until the council adopts a
supplemental budget under the oregon Local Budget Law, or until
. 60 days, whichever is less.
2.605 Ambulance Services - Fees.
(1) The city manager may set all rates and fees for
any ambulance service operated by the city. Except in an emer-~
gency when such rates and fees may be immediately imposed, all
rates and fees shall be established only after public notice,.
hearing and findings that the proposed adjustments are:

~b~ Except as approved by the council, ~.nsure
the ambulance service will not draw on the general
tax revenues of the city, and
~c~., will insure those who receive the service
pay in proportion to the cost of the service provided.
~:2} The decision of the city manager to establish
rates and, fees in subsection awl}_ above shall be final unless
an aggrieved person appeals the decision to the council. The
appeal shall be in writing and filed with the council within
30 days of the city managers decision. Except in an emergency,
the appeal suspends implementation ~f the city manager's deci-
sion until the council hears the appeal,. The council shall
hear the appeal promptly and affirm, modify or repeal the deci-

sion of the city manager.
~ 3 } The city manager or ha,s designate shad l pursue
collection of the fees and charges established under subsection
~1} and ~_2} by all lawful remedies available to the city to re-~
cover costs for services rendered plus collection costs, includ--
ing attorney fees.
Section 2. That the provisions contained herein concern the
public health, welfare and safety and therefore, an emergency is
hereby declared to exist, and this Ordinance shall become effective
immediately upon its passage by the City Council and approval by
the Mayor.
