HomeMy WebLinkAboutOrdinance No. 18746ORDINANCE I10. ~7~~ An ordinance vacating the following described street, to--wit: Beginning at the southeast corner of Lot 3, Block 1, CRESTVZEW~ADDITIoN as platted and recorded in Book 16, Page Z1, Zane County Plat Records, Zane County, oregon; thence south 89°46'00' west along the south boundary of said Lot 3 northerly margin of proposed vacated streets 194,9 feet more or less to a point 40,04 feet easterly parallel and perpendicular to the centerline of w~illamette Street; thence southerly along a line parallel to the centerline of Willamette Street 50 feet to a point on the northerly boundary of Lot 1, Block 4, of the above described plat, said point being on the Southerly margin of the proposed vacated street; thence north 89°46'44" east along this southerly margin 190,9 feet more or less to a point which is in alignment with the westerly margin of oak Street; thence northerly 54 feet to the point of beginning, all in Eugene, Lane County,oregon. RESERVING herein a public utility and bikeway ease- ment on the ground, above the ground, and beneath the ground across the northerly l4 feet of the above described property, and the right to enter thereon for the purposes of construction, reconstruction and maintenance thereof. ~Krumdieck, Inc. SV 80-17 On the 34th day of July, 1980, the City Council of the City of Eugene passed ordinance No. 18657 setting a hearing to be held on the 17th day of September, 1984, at the Council Chambers at City Hall, Eugene, oregon, at wh%ch time and place protests and remonstrances could be heard as to the proposed vacation of the above described ...,. ~~ street. Notice was duly and regularly given of the hear~,ng and a hear- ing was held pursuant to the ordinance at the Council Chambers, at City Hall, Eugene, oregon, on the l7th day of September, 1984, at Noon, Pacific Daylight Time, and at said time and place the Council heard all objections. Ordinance - 1 181'f6 All persons owning property abutting upon the street to be va- sated have consented to the vacation and applied for the same. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required and no valid objections have been made at the hear- ing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the street.. Section ~. The hearing was held on the 17th day of September, 19 80 at noon, Pacific Daylight Time, at the Council Chambers , Casty Hall, Eugene, Zane County, Oregon, and all matters necessary to be done in the pre~ises have been duly and re~ulaxly completed. Section 3. The hereinabove described street is hereby vacated, and the street so vacated shall revert pursuant to the statutes of the State of oregon. Section 4. The City Recorder is hereby directed to file a cer- of ied copy of this Ordinance pith the Recorder of Lane County, Oregon, together with ~a map or plat of said property, and a certi- fied copy of this ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor.
