. CEEDINGS IN .EMINENT DO~~AIN FOR .T~~E ACQUISITIQN
BY CONDEMNATION ~F PROPERTY INTER~5TS IN THE
. VICINITY OF COUNTRY CLUB, ROAD FaR~THE PURP4SES~
of STREET WIDENING AND RELQCATION, AND THE CON--
. STRUCTI~N aF S=DEWALKS, STaRM SEWERS, AND SANI~-
TARY.SEWERS; AND DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
Thy City Council has authority under provisions of the,~ity
Charter and applicable state. law to institute proceediri s in~~eminent

.~ .domain for the acquisition by condemnation of private ro ert far

public purposes, including the widening and re~location~af city streets
and the construction and improvement of sidewalks, storm sewers and

sanitary sewers, .
T~~e City of Eugene is in the process of improvin ~ cit streets

in order to facilitate the safe and efficient movement of traf f~ic
.~
over~the streets. Because the increased volume of traffic usin
g
Country~Club Road in its present condition creates a traffic hazard
.endangering persons and' property., it is necessary to improve the flow
of traffic thereon, which may be accomplished by.relocatin ortions

thereof and widening the street,
The City of Eugene is also in the process of im rov~.in ex and-

ing, and maintaining the~city sewer and draina e s stem to rovid

for the proper disposal of sewage and drainage in a safe~and healthy
manner~necessa~ry for the preservation and protection of the health
and safety of the citizens of the City.
.The street relocation and widening and the construction of side-~
walks, drainage and sewer systems in the vicinity of Countr Club Road

necessitates~~ the acquisition by ~ the City of ,certain property :rights
. in the parce~ls~ ~of veal property described .on the attached exhibits
which in the City's judgment constitutes the most beneficial and
. practical location for the improvements .
. ~ The proposed improvements .are in compliance with and~in further-
ance of the plans and specif icat~ions prepared . by the C.i t En ineer

at~the Council's direction and in accordance with provisions~of the..

Eugene Code, 1971, and applicable policies and agreements of the City
of Eugene. Now, therefpre,
~~~ THE. CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
. Suction 1. used upon the above findings, the Cit Council of

. the City of. Eugene does hereby. find, declare, and determine it neces- .
sary to acquire certain ownership in ,fee interests, permanent ease--
~ments and temporary ~ construction easements 'to the parce~.s of real
.property rr~are particularly described on the Exhibits which are
attached hereto and in~carporated herein by reference, in order to
accomplish. the ~ relocation and .widening .of Countr Club Road and o

~~ ~.
~co~nstruct, reconstruct and maintain sidewalks, storm sewers and sari-~
,tar~r sewers, including all appurtenances. thereto, in accordance with i
plans prepared by the- City of Eugene Departnierit of Public Works and
approved by the City ;Manager. ~ .
. Section z . The ~ City Council does hereby direct that the City of
.Eugene shall institute ~p.roceedings in ~ eminent domain for. the conde~m`-
~~nation~of 'the above described interests in real property,~and, at
. leash ~~ days prier ~to the filing of any action for condemnation to
make .a written offer to the owners,ar parties having an interest

.therein of a stated amount as compensation therefor and fo.r ~ any. com-
pen~able damages to remaining pr~aperty~.
. Section 3. The City .Council hereby declares .that the im rove-

meats above set forth are for a public purpose,. are necessar for

the public welfare, and are authorized under, the laws of the State
of Oregon and Charter and ordinances of the Ci~t o.f Eu ene.

Section 4~. The City Council further declares that the inter--

ests in real property described on the Exhibits attached hereto and

for public purposes at the earliest possible date and, iri any event,
