X8755 An Ordinance initiating the ~racation of the following described public utility easement, to--wit: Lots 1, 2, 3, ~, 5, 6, 7, 8, 9, 1~, 11, lZ, l3, l4, 1~, 16, flock 2, and Fergus Street west of the west right--af~-way margin of E~.izabeth Street of Fergus Manor as platted and recorded in File 73, Slide 345, Lane County Plat Records, Lane County, Oregon. RESERVING herein a 7 foot public utility easement on the ground, beneath the ground, and above the ground, along the easterly boundary of Lot 16 and the right to enter thereupon for purposes of construction, re- canstructon and maintenance. Spring Const. Ev 80-7} THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of th.e City of Eu ene herein ini- g tiates the vacation proceedings on its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described public utility easement. Section ~, A hearing shall be held upon the proposal to vacate the public utility easement as here~,n provided,, and. the hearing shall be held on the 11th. day of March, 1981, at noon Pacific Standard Time of said date, at the Council Ch.arnbexs at City Hall, Eugene, Oregon, at which time all persons wild. be heard ~~upon objections or suggestions with regard to the~~acaton, and at said time the Council will p~.~o-- *~ide for the vacation of the publa:c uti.li,ty easement or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by ~,ocal assessment. Section 3. The City Retarder is hereby directed to immediately publish once each week. for four consecuti~~re weeks in a newspaper pub lisped in Eugene, Lane County, Oregon, native of .the proposed vaca- tion. The notice shall gi~~e a description of the area to be vacated Ordinance - 1 18755 as herein set out; state th.e date when this ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petition, together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be~heard and considered. Section 4. The City Recorder shall forthwith and within five days after the first publication of the notice post, or cause to be pasted, at or near each end of the proposed vacation a copy of the foregoing, which. shall be headed "Notice of Public Utility Easement vacation," and which notice shall be posted in at least two conspi- cuous places in or on the area proposed to be vacated. The posting and the first day of publication of the notice shall be not less than twenty-eight ~~8}_ days before the time set far hear- ing.
