ISSUE STATEMENT
As required by Oregon Revised Statutes, Chapter 222, properties annexed to cities must be withdrawn
from some special districts through a separate process after annexation of territories becomes effective.
The council is asked to adopt the attached ordinance providing for withdrawal of recently annexed areas
from special districts (see Attachment A) immediately following the public hearing.
BACKGROUND
Withdrawals routinely come before the council at least once each year. Properties annexed during
previous months are batched together to facilitate this process. This batch consists of all the 2005 and
some 2006 annexations for which withdrawal from one or more special districts is necessary.
Maps showing the location of each annexed property subject to withdrawal from one or more special
districts are included in this council packet (see Attachment B).
Financial and/or Resource Considerations
Failure by the City to withdraw properties from special districts before the County Tax Assessor creates
the new tax rolls for the coming year results in the property remaining on the tax roll of the special
district that no longer provides service. Withdrawal from special fire districts occurs automatically
pursuant to state law.
Timing
If the withdrawal ordinance is not effective by March 31, 2006, these properties will remain on the tax
roll of the special service districts during the coming fiscal year. Since this is a routine action, staff will
request that the council take action following the public hearing on March 13, 2006.
Stakeholder Perspective
All annexations were initiated at property owner request, usually to facilitate development. The change
to City tax rolls was expected by the applicants.

RELATED CITY POLICIES
There are no City policies to which this item is related. Properties are withdrawn from special districts
upon annexation to the City because the City takes over responsibility for providing urban services.
Withdrawal of properties from rural fire protection districts occurs automatically upon annexation, while
a separate process is required by State law for withdrawals from many other special districts.
COUNCIL OPTIONS
There are few options and action is time-sensitive. If the ordinance approving withdrawals from special
districts is not effective by March 31, 2006, the properties will remain on tax rolls for special districts
for the coming fiscal year.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends adoption of the proposed ordinance.
SUGGESTED MOTION
Move to adopt the proposed ordinance to withdraw territories from the River Road Water District and
River Road Park and Recreation District, from the Santa Clara Water District.

ORDINANCE NO.
AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES
FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD
PARK AND RECREATION DISTRICT, AND FROM THE SANTA
CLARA WATER DISTRICT.
The City Council of the City of Eugene fmds that:
A. Resolution No. 4857 adopted on January 23,2006, proposed withdrawal from the
River Road Water District, the River Road Parks and Recreation District, and the Santa Clara
Water District ("the Districts"), the parts of the Districts annexed to the City as described therein.
B. The Resolution set February 27, 2006, at 7:30 p.m., in the Council Chambers,
City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals,
and directed that notice of the time and place of the hearing be published once each week for two
successive weeks prior to the hearing and that the notice be posted in four public places in the
City for the same period. The Notice has been so published in the Register Guard and posted in
four public places in the City of Eugene, Oregon. However, in order to comply with the
Ordinance notice requirements of the Eugene Charter 2002, it was necessary to reschedule the
public hearing to March 13, 2006. A Notice advising of the March 13, 2006 hearing date was
published in the Register Guard once each week for two successive weeks prior to the hearing,
and posted in four public places in the City for two successive weeks prior to the hearing. In
addition, City staff attended the February 27, 2006 Council meeting and advised those in
attendance of the rescheduled hearing date.
c. The City is willing to assume the liabilities and indebtedness previously
contracted by the Districts proportionate to the parts of the Districts that have been annexed to
the City upon the effective date of the withdrawals.
D. The withdrawals of the annexed territories from the Districts are consistent with
the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area
General Plan, and other adopted City policies, and it is in the best interest of the City that the
territories be withdrawn.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on May
9,2005, by Notice of the Lane County Local Government Boundary Commission dated January
9,2006, as bounded and described as follows:
Tax Lot 300, Assessor's Map 17-04-23-20 and a portion of Rosy
Turn right-of-way, located in the River Road region of north
