HomeMy WebLinkAboutAdmin Order 53-24-09 -- Extending Emergency Building Code Rule AmendmentADMINISTRATIVE ORDER NO.53-24-09 of the City Manager of the City of Eugene EXTENDING THE EMERGENCY AMENDMENT OF REGULATIONS FOR ADMINISTRATION AND ENFORCEMENT OF THE BUILDING, FIRE AND OTHER TECHNICAL CODES ADMINISTRATIVE RULE R-8.005 ADOPTED BY ADMINISTRATIVE ORDER NO. 53-23-03-F. The City Manager of the City of Eugene finds that: A. Pursuant to the authority contained in Sections 2.019 and 8.005(1) of the Eugene Code, 1971 (EC), Regulations for Administration and Enforcement of the Building, Fire and Other Technical Codes Administrative Rule R-8.005 was adopted by Administrative Order No. 53-23- 03-F on November 6, 2023. B. EC 2.019(6) authorizes the City Manager to adopt emergency rules that adopt, amend, or suspend a Rule without prior notice or hearing. Pursuant to that authority, on January 24, 2024, I issued Administrative Order No. 53-24-01 adopting an emergency amendment to Administrative Rule R-8.005 to grant additional time for building permit applicants to complete the process of obtaining their permits. The emergency rule amendment expires on July 22, 2024. C. High construction material costs, financing costs, market uncertainty, supply -chain issues in critical industries, and availability of contractors and subcontractors have greatly increased the risks associated with development and caused permit applicants to reanalyze and delay moving forward with their projects. D. A failure to extend this amendment will result in serious prejudice to Eugene property owners and those in the building trades who are temporarily unable to move forward with building permit applications as they originally intended within the timeline described in the Administrative Rule because, without this amendment, those parties would be required to go through a costly re -application process. Providing additional extension requests will allow housing and other permits related to economic recovery to remain viable. NOW, THEREFORE, based upon the above findings and pursuant to the authority in subsection (6) of Section 2.019 of the Eugene Code, 1971, I order that the amendment to Section R-8.005-B(3)(e)l of Rule R-8.005 shown in legislative format below shall be extended effective July 22, 2024, and remain in effect until January 18, 2025, (180 days from July 22, 2024), unless replaced earlier by an emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions of EC 2.019. (3) Determination and Issuance of Permits (e) Expiration. 1. Permit Applications. Applications for which no permit is issued within 360 days following the date of application shall automatically expire, and plans and other data submitted for review may thereafter be destroyed by the City. The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon request by the applicant. No application shall be extended more than enee twice. In order to renew action on an application after expiration, the applicant shall resubmit plans and may be subject to a new plan review fee. -Aa LE AJB LB Dated this 15th day of July, 2024.
