HomeMy WebLinkAboutAdmin Order 58-24-39 -- Delegating Industrial Pretreatment Auth to StaffADMINISTRATIVE ORDER NO. 58-24-39 of the Wastewater Division Director DELEGATING THE AUTHORITY TO ENFORCE THE CITY'S INDUSTRIAL PRETREATMENT PROGRAM AND REPEALING ADMINISTRATIVE ORDER NO.58-09-13. The City of Eugene Wastewater Division Director finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the City Manager is designated as the administrative head of the City and is specifically authorized to enforce all ordinances of the City. B. In addition to the above -listed authority, Section 6.550(3) of the Eugene Code, 1971 (EC), authorizes the City Manager, or the City Manager's designee, to administer, implement, and enforce the provisions of EC 6.550 to 6.586 which establish the City's Industrial Pretreatment Program. C. On July 2, 1996, the City Manager issued Administrative Order No. 58-96-09 which jointly delegated to the Director of the Public Works Department and to the Director of the Planning & Development Department the authority to perform and carry out the duties or responsibilities of the City Manager under Chapter 6 of the Eugene Code, 1971, except for: the adoption, amendment, or repeal of any rules authorized therein; the adoption, amendment, or repeal of any fees or fee schedules authorized therein; or decision -making authority with respect to appeals or determinations to implement legal proceedings on behalf of the City. That Administrative Order also provided that each Director may in turn delegate any of the duties or responsibilities delegated therein to such person or persons qualified to perform the delegated duties upon finding it would be more efficient and in the public interest to do so. D. On October 31, 2024, the Director of the Public Works Department issued Administrative Order No. 53-24-38 delegating to the Wastewater Division Director the authority to administer, implement, and enforce the City Industrial Pretreatment Program as established by EC 6.550 to 6.586. That Administrative Order also provided that the Wastewater Division Director may delegate any of the duties or responsibilities delegated therein to such person or persons qualified to perform the delegated duties upon finding it would be more efficient and in the public interest to do so. E. I find it would be more efficient and in the public interest to sub -delegate the authority to enforce the City's Industrial Pretreatment Program as described in this Administrative Order. Administrative Order -- Page 1 of NOW, THEREFORE, The Wastewater Division Director directs that: 1. As of the effective date of this Order, without limiting my authority, I delegate the authority to enforce the City's Industrial Pretreatment Program as established by EC 6.550 to 6.586 as follows: Enforcement Action Authorized Employee(s) Informal Communication Environmental Compliance Specialist (Regulatory Services) Environmental Services Lead (Regulatory Services) Regulatory Services Supervisor Warning Letter Environmental Services Lead (Regulatory Services) Regulatory Services Supervisor Notice of Violation Regulatory Services Supervisor Notice of Administrative (Civil) Regulatory Services Supervisor Penalty Compliance Schedule Regulatory Services Supervisor 2. The delegations of authority contained herein shall be construed to extend to and include any person(s) "acting in capacity" (AIC) for the persons whom authority is delegated. 3.
