HomeMy WebLinkAboutAdmin Order 58-24-37-F -- Industrial Pretreatment Rule AmendmentsADMINISTRATIVE ORDER NO. 58-24-37-F of the City Manager of the City of Eugene AMENDING AND REPLACING INDUSTRIAL PRETREATMENT PROGRAM ADMINISTRATIVE RULE R-6.501 ADOPTED BY ADMINISTRATIVE ORDER NO. 58-23-02-F; AND RENAMING IT TO INDUSTRIAL PRETREATMENT PROGRAM ADMINISTRATIVE RULE R-6.550. The City Manager of the City of Eugene finds that: A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules for implementation of any provisions of the Code. Section 6.550 of the Eugene Code, 1971, authorizes the City Manager to adopt rules to administer, implement, and enforce the provisions of EC 6.550 to 6.586 to ensure that the City's industrial pretreatment program complies with the objectives of EC 6.550 to 6.586, the applicable state and federal laws and regulations and the City's policy to cooperate with state and federal government. Pursuant to that authority, on June 15, 2023, Administrative Order No. 58-23-02-F was issued making the most recent amendments to Industrial Pretreatment Program Administrative Rule R-6.501 ("the Rule.") B. On November 6, 2024, I issued Administrative Order No. 58-24-37 ordering that notice be given of the opportunity to submit written comments on a proposal to amend the Rule so that it conforms with changes to the Code that were implemented by Ordinance No. 20688, which took effect on June 24, 2024, by deleting sections of the Rule that are now addressed in the Code. The industrial pretreatment sections of the Code were renumbered by Ordinance No. 20688, so it is also necessary to rename the Rule to reflect the new Code number. C. Notice of the proposed amendments to the Rule was given by making copies of the Notice available to any person who had requested such notice and by publication of the Notice in the Register Guard newspaper on November 11, 12, 13, 14, and 15, 2024, providing interested persons an opportunity to submit comments on the proposed amendments until the end of the day on November 26, 2024. No comments concerning the proposed Rules were submitted within the time or in the manner set out in the Notice. On the basis of these findings, I order that: 1. Industrial Pretreatment Program Administrative Rule R-6.501 is renamed to Industrial Pretreatment Program Administrative Rule R-6.550 and is amended as set forth below. 2. The unamended provisions of Industrial Pretreatment Program Administrative Rule R-6.501 adopted by Administrative Order No. 58-23-02-F are reaffirmed and incorporated into Industrial Pretreatment Program Administrative Rule R-6.550 adopted by this Order. Administrative Order - Page 1 of 3 3. Administrative Order No.- 58-23-02-F is superseded by this Administrative Order No. 5 8-24-3 7-F as of the effective date of this Order. 4. As of the effective date of this Order, the following is Industrial Pretreatment Program Administrative Rule R-6.550: INDUSTRIAL PRETREATMENT PROGRAM ADMINISTRATIVE RULE R-6.550 R-6.550-A General Provisions These rules are intended to ensure that the City's pretreatment program complies with the objectives of the Eugene Code, 1971, applicable state and federal law, and rules and regulations adopted thereunder. Notwithstanding the specific requirements of these rules, each industrial user of the City Sewerage System shall comply with all applicable local, state and federal laws and regulations governing the pretreatment of industrial wastes. Therefore, all references in these rules to other statutes and regulations are to those statutes and regulations as amended. R-6.550-B Specific Restricted Substance Limitations No significant industrial user shall discharge wastewater containing pollutants in excess of the maximums shown on the following table or in concentration limits set by any local, state or federal regulatory agency having jurisdiction, whichever is stricter: Pollutant Maximum Arsenic, Total 0.19 milligrams per liter Cadmium, Total 0.10 milligrams per liter Chromium, Total Categorical Limit, where applicable Copper, Total 1.8 milligrams per liter Lead, Total 0.69 milligrams per liter Mercury, Total 0.036 milligrams per liter Nickel, Total 1.9 milligrams per liter Silver, Total 0.14 milligrams per liter Administrative Order - Page 2 of 3 Zinc, Total 4.9 milligrams per liter R-6.550-C Annual Permit Fee A nonrefundable annual permit fee in an amount established by the City Manager pursuant to Section 2.020 of the Eugene Code, 1971 shall be paid for each industrial wastewater discharge permit.
