HomeMy WebLinkAboutAdmin Order 56-25-01-F -- Amending and Replacing Private Commerce on Public PropertyADMINISTRATIVE ORDER NO. 56-25-01-F of the City Manager of the City of Eugene AMENDING AND REPLACING PRIVATE COMMERCE ON PUBLIC PROPERTY ADMINISTRATIVE RULE R-3.336 ADOPTED BY ADMINISTRATIVE ORDER NO. 56-17-02-F; AND REPEALING ADMINISTRATIVE ORDER NO. 56-24-03. The City Manager of the City of Eugene finds that: A.Pursuant to the authority contained in Sections 2.019 and 3.340 of the Eugene Code, 1971, the City Manager has adopted the Private Commerce on Public Property Administrative Rule R-3.336 ("the Rule"). The most recent changes to the Rule were adopted on July 12, 2017, by Administrative Order No. 56-17-02-F. B.During the COVID-19 pandemic, the City Manager adopted a series of emergency orders allowing the City to issue temporary permits for outdoor seating within the public right-of­ way, most recently by Administrative Order No 56-24-03. These temporary permits were issued to support restaurants and to allow patrons to socially distance. The City received positive feedback on the program from both patrons and businesses; therefore, on March 19, 2025, I issued Administrative Order No. 56-25-01 ordering that Notice be given of the opportunity to submit written comments on a proposal to amend the Rule to make the program permanent. C.Notice of the proposed amendments to the Rule was given by making copies of the Notice available to any person who had requested such notice and by publication of the Notice in the Register Guard newspaper on March 23, 24, 25, 26, and 27, 2025, providing interested persons an opportunity to submit comments on the proposed amendments until the end of the day on April 7, 2025. The written comments received during the public comment period are addressed in the City Manager's Findings in Consideration of Written Submissions attached as Exhibit A to this Order. On the basis of these findings, I order that: 1.Private Commerce on Public Property Rule R-3.336 is amended as set forth below as of the effective date of this Order. 2.The unamended provisions of Private Commerce on Public Property Rule R-3.336 adopted by Administrative Order No. 56-17-02-F are reaffirmed and incorporated into Private Commerce on Public Property Rule R-3.336 adopted by this Order. 3.Administration Order No. 56-17-02-F is superseded by this Administrative Order No. 56-25-01-F as of the effective date of this Order. 4.Administrative Order No. 56-24-03 is repealed as of the effective date of this Order. 5.The term of any temporary permits issued pursuant to Administrative Order No. 56- Administrative Order -Page 1 of 29
