ADOPTED: February 23, 2026 SIGNED: February 25, 2026 PASSED: 8:0 REJECTED: OPPOSED: ABSENT: EFFECTIVE: February 25, 2026 • ORDINANCE NO. 20735 AN ORDINANCE CONCERNING MUNICIPAL COURT BECOMING A COURT OF RECORD; ADDING SECTION 2. 771 TO THE EUGENE CODE, 1971; DECLARING COMPLIANCE WITH ORS 221.342(2); AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 2.771 is added to the Eugene Code, 1971, to provide as follows: 2. 771 Municipal Court -Court of Record. The Eugene Municipal Court is a court of record. Section 2. In accordance with the requirements of ORS 221.342(2), the Eugene City Council declares as follows: (a) The Eugene Municipal Court satisfies the requirements for becoming a court of record set forth in ORS 221.342. (b) The address and telephone number of the clerk of the Eugene Municipal Court are as follows: 1102 Lincoln St. Eugene, OR 97401 Phone: 541-682-5400 (c) The Eugene Municipal Court will commence operations as a court of record on April 1, 2026. Section 3. This Ordinance shall serve as the Eugene City Council's declaration that is required by ORS 22.342(2) for the Eugene Municipal Court to become a court of record. The City Manager is directed to file this declaration/ordinance with the Oregon Supreme Court and request entry of an order by the Supreme Court acknowledging the filing of this declaration. Ordinance -Page 1 of 2 Section 4 . The City Recorder, at the request of, or with the consent of the City Attorney, is authorized to administratively correct any reference errors contained herein, or in other prov isions of the Eugene Code, 1971, to the provisions added, amended or repealed herein . Section 5. As a result of Oregon House Bill 2460, adopted by the Oregon Legislature during the 2025 Legislative Session and effective on January 1, 2026, it is necessary to immed iately amend the City Code to make the Eugene Municipal Court a court of record. Therefore, pursuant to the provis ions of Section 32(2) of the Eugene Charter of 2002, with the affirmative vote of two-thirds of the members of the City Council, this Ordinance shall become effective upon adoption by the Council and approval by the Mayor , or passage over the Mayor's veto .
