ADMINISTRATIVE ORDER NO. 58-26-05
of the
Executive Director of the Public Works Department
EXTENDING THE TEMPORARY CLOSURE OF A PORTION OF SCOBERT
PARK ENABLED BY ADMINISTRATIVE ORDER NO. 58-24-08.
The Executive Director of the Public Works Department finds that:
A. Pursuant to the authority of Administrative Order No. 21-03-12 issued by the City
Manager, the Executive Director of the Public Works Department is authorized to regulate City
parks, protect park visitors and the park environment, and adopt rules regarding the use of parks.
B. Section 1.003 of the Parks and Open Space Rules authorizes the temporary closure
of all or any portion of a park, open space, or facility upon finding that conditions that threaten the
welfare or safety of nearby residents exist and the need to preserve their welfare and safety
outweighs the public’s right of access to the park, open space and/or facility.
C. On April 16, 2010, Administrative Order No. 58-10-04 was issued closing a portion
of Scobert Park, located at 1180 West 4th Avenue, effective 12:01 a.m. on April 23, 2010, until
April 22, 2012. The closure has subsequently been extended, most recently by Administrative
Order No. 58-24-08, which extended the temporary closure until April 22, 2026.
D. The above-mentioned portion of Scobert Park became a haven for illegal activities,
creating an atmosphere that threatened the welfare and safety of the residents in the area. Prior to
its closure, efforts to curtail the illegal activities, including the fencing of the area, were
unsuccessful. Therefore, it was necessary to close the portion of Scobert Park, and it is necessary
that it remain closed until the Park is redesigned and redeveloped.
E. The need to protect and preserve the welfare and safety of residents living nearby
Scobert Park outweighs the public’s right of access to the fenced portion of Scobert Park.
NOW, THEREFORE, based on the above findings, I order that:
1. The closure of the portion of Scobert Park, located at 1180 West 4th Avenue,
delineated by a black wrought iron fence erected by the City, is extended and shall be closed to
entry by all persons other than police officers, authorized City employees and persons with written
authorization from the Public Works Director or the Parks Maintenance Manager until April 22,
2028.

2. In addition to any other measures that may be implemented to ensure that entry to
the closed portion of Scobert Park is restricted, the City shall maintain fences or other barriers
around the closed area and shall post clearly visible signs advising the public that, pursuant to
Administrative Order of the Public Works Executive Director, the fenced area is closed and
unauthorized entry into the fenced area is prohibited.
