The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. Pursuant to that authority, on August 10, 2023, Administrative Order No. 52-23-03-F was issued establishing the current Fire and EMS Department Services and Fire Safety and Hazardous Materials Permit Fee Schedule ("the Fee Schedule"). B. In determining whether to amend the Fee Schedule, in accordance with EC 2.020(2), I have considered the following factors: applicable policies, enactments and directives of the City Council ; the amount charged for these services by the City in the past; the full costs of providing the services supported by the fees; the amounts charged by other comparable providers; and the revenue needs of the City as determined by the adopted City budget. (See Exhibit C) C. Based on my consideration of the factors listed above, I propose to replace the Fee Schedule with an updated Fee Schedule as set forth in the Notice attached as Exhibit A to this Order. On the basis of these findings, I order that: 1. A copy of this Order with its exhibits shall be provided to the Mayor and City Councilors, and a Notice substantially conforming to the Notice attached as Exhibit A shall be made available to any persons who have requested s uch notice and posted at two locations at City Hall. 2. A Notice substantially conforming to the Notice attached as Exhibit B which contains tho se fees proposed to be $250 or more shall be publi shed in the Register Guard Newspaper. Pursuant to the provisions of Section 2.020 of the Eugene Code, 1971, and as a result of an investigation of the revenue needs of the City in providing Fire and EMS services and Fire Safety and Hazardous Materials permits, the City Manager is proposing to amend the following fees in the Fire and EMS Department Services and Fire Safety and Hazardous Materials Permit Fee Schedule. The table below sets out the current fees and the proposed fees. Proposed changes to the fee descriptions are shown in blue underlined type for additions and red strikethrough for deletions. Haruyama, City Manager Date of Publication: June 17, 2026 Exhibit C to Administrative Order 52-26-03 Page 1 of 2 City Manager’s EC 2.020(2) Findings for Proposed Fire Marshal’s Office Services and Operational Permit Fee Schedule Section 2.020(2) of the Eugene Code, 1971, requires that in determining the amount of any City fee, the City Manager must consider the factors listed below unless a factor is irrelevant or inapplicable. The following findings address each factor: (a) Applicable policies, enactments, and directives of the Council. Findings: Section 8.010(1) of the Eugene Code authorizes the City Manager to adopt a local fire code and associated fees. Section 8.010(3) authorizes inclusion of requirements for staff services and operational or construction permits, as well as provisions for payment of related fees. The proposed fee schedule amendments coincide with the adoption of the 2025 Oregon Fire Code, which adds new permit types, adjusts several existing permit requirements, and clarifies operational expectations. The proposed fee changes reflect these updated code requirements and the associated administrative responsibilities required of the Fire Marshal’s Office. (b) The amount charged by the City in the past. Findings: The proposed fee schedule includes increases, decreases, and consolidations when compared to past charges. Many fees are increased to reflect the actual cost of staff time based on updated workflows and revised permit administration requirements. Some fees are reduced where previous charges exceeded the necessary cost of service or where efficiencies have been identified. Several fees have been added or modified to support new permit types introduced in the 2025 Oregon Fire Code. The resulting fee schedule is better aligned with current operational demands and with comparable jurisdictions. (c) The full costs of providing the service supported by the fee. Findings: The revisions to staff service rates and operational permit fees are designed to recover the actual cost of providing plan review, inspections, fire investigations, code interpretation, travel time, customer coordination, data entry, and associated administrative tasks. Many fee changes directly reflect documented staff time requirements and the cost of administering permits, including those newly required under the 2025 Oregon Fire Code. Consolidation of hazardous materials permits under OFC Section 105.5.23 and multiple fee adjustments throughout the schedule are based on accurate service-delivery cost calculations and ensure proportional recovery across small and large occupancies. (d) The amounts charged by other comparable providers. Findings: Staff reviewed fee schedules from multiple Oregon fire and life safety agencies. The updated fees align with those of comparable providers such as Clackamas Fire District, Bend Fire and Rescue, Tualatin Valley Fire and Rescue, and statewide programs administered by the Department of the Oregon State Fire Exhibit C to Administrative Order 52-26-03 Page 2 of 2 Marshal. These comparable agencies use similar cost-recovery models to charge for plan review, inspections, investigations, and permit administration. The proposed fee levels are consistent with regional practice and do not place Eugene businesses at a competitive disadvantage. (e) The revenue needs of the City as determined by the adopted city budget. Findings: The proposed updates support the City’s budgetary and operational needs by ensuring that services and permit programs offered by the Office of the Fire Marshal are funded proportionate to the cost of providing them. The revised fee schedule creates a more stable and predictable funding structure, allowing the City to maintain essential fire and life-safety services without shifting additional burden to the general tax base. Fees are calibrated to ensure that users of specialized inspection and review services contribute appropriately to the cost of those services, promoting a transparent and equitable cost-recovery model.
