HomeMy WebLinkAboutAdmin Order 21-26-02 -- Prohibiting NDAs for data centersADMINISTRATIVE ORDER NO. 21-26-02 of the City Manager of the City of Eugene, Oregon EST AB LIS HING CITY POLICY PROHIBITING NON-DISCLOSURE AGREEMENTS FOR DATA CENTER PROJECTS. The City Manager of the City of Eugene finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the City Manager is designated as the adm ini strative head of the City, specifica ll y authorized to enforce all ord in ances of the City, to appoint and remove all employees, to assign the duties of a ll _ administrative emplo yees, and a ll administrative employees shall be responsible and accountable to the City Manager. B. Both nationally and in Oregon there has been an increase in deve lopment proposals for large-scale (hyperscale) data cente rs. Large-scale data centers are energy and resource intensive, and have the potential to impact energy affordabi lity and reliability, air quality, water resources, noise levels, land use, public h ealth, and the environment. As such, the public is acutely interested in knowing when a developer is considering locating a large-sca le data center in Eugene. C. While some cities in Oregon a nd across the country have executed non-disclosure agreements w ith data center developers, the City of Eugene is not a party to a non-disclosure agreement in connection w ith any data center project. D. In keeping with the City 's dedicated comm itm ent to transparency and in recognit ion of the strong public interest in data center development, it is important to ensure that no City employee enters into a non-disclosure agreement in connection with a data center project. NOW, THEREFORE, based upon the above findings, I order that: Section 1. City employ ees are prohibited from using or s igning a non -di sclos ure agreement in connection w ith a data center project. Section 2. The Executive Director for each C it y department s hall convey this Policy to employees within their Department.
