BACKGROUND Each year, the City Council makes appointments of citizen members to the Budget Committee during the Boards and Commissions recruitment and appointment processes. ORS 294.336 requires that “if any appointive member is unable to serve the term for which the member was appointed, or an appointive member resigns prior to completion of the term for which the member was appointed, the governing body of the municipal corporation shall fill the vacancy by appointment for the unexpired term”. The council is asked to make an interim appointment for the unexpired term of Noah Kamrat expiring on June 30, 2012. Other Background Information Noah Kamrat was appointed a citizen member of the Budget Committee on October 27, 2008. Due to a work assignment outside of the country, Mr. Kamrat was unable to attend Budget Committee meetings in 2008 and 2009. City staff made several attempts to contact Mr. Kamrat in the fall of 2009 to ascertain his availability and willingness to serve on the Budget Committee, but were unable to reach him. In December of 2009, the City Council was asked to vote using the pool of applicants who previously applied in the fall and expressed an interest in serving on the Budget Committee. Two candidates, Shanda Miller and Aaron Walker, have received an equal number of votes. COUNCIL OPTIONS The City Council may make its candidate selection based on the December 2009 ballot, or may reopen the recruitment process for the Budget Committee appointment. CITY MANAGER’S RECOMMENDATION The City Manager recommends the appointment of Shanda Miller or Aaron Walker to the Budget Committee. SUGGESTED MOTION Move to appoint _______________ as an interim appointment to the Budget Committee to Position 6, the unexpired term of Noah Kamrat, which will expire on June 30, 2012. You must now decide how this vacancy will be filled. Please take a moment to review the options below and communicate your preference to me by no later than December 7, 2009 . ? Nominate a candidate from the recently completed annual recruitment ? Select one or more candidates from the existing applicant pool to interview ? Other: __________________________________________________ The next Budget Committee meeting is being planned for late January/early February. Staff is providing general orientation sessions for all advisory group members on Dec. 12 and Jan. 12, and is also developing a Budget Committee orientation session specifically for Ramin Shojai before the committee’s next meeting in January. It would be optimal to hold that session with both new members if possible. As background, Mr. Kamrat was appointed to the Budget Committee in November 2008, but did not attend meetings because of his work obligations. In anticipation of the 2010 budget season, staff attempted to contact Mr. Kamrat by phone and left messages on October 12 and October 21 asking him if he would be able to attend the upcoming meetings. An email asking him if he would be able to attend the November 2 Budget Committee meeting was also sent on October 28. With the concurrence of Budget Committee Chair John Barofsky, a certified letter was sent to Mr. Kamrat on November 10 informing him that he would be replaced if staff did not hear from him by November 16. To-date, no communication or response from Mr. Kamrat has been received. Copies of the applications received for the Budget Committee, the final appointment ballot, and the certified letter sent to Mr. Kamrat are attached below.
