(CONTRACT 2009 -18) (JOB #4275) The City Council of the City of Eugene finds that: A. This project was initiated by Council action on April 11, 2005 by adoption of the 2006 Capital Improvement Plan and pursuant to Section 7.160(5) of the Eugene Code, 1971 (EC). The preparation of plans and specifications and call of bids for construction of the local improvements are based on Council Action on April 11, 2005 pursuant to EC 7.160(5). The local improvements consist of paving and constructing curbs, gutters, sidewalks, street lights, stormwater drainage and water quality facilities on Elmira Road from Bertelsen Road to Maple Street and on Maple Street from Elmira Road to Roosevelt Boulevard. B. After due notice and a public hearing before the hearings official on April 2, 2009, the City Council formed the Local Improvement District and, on April 13, 2009, authorized construction of the local improvement. C. The actual cost of the local improvement is ascertained to be $2,919,363.70, and the amounts to be assessed to, and borne by, the specially benefited property, and the amounts to be borne by the City or others, have been determined in accordance with applicable provisions of the Eugene Code and as set forth in the attached Exhibit A, which is incorporated herein by reference. D. The City Council has established the method of calculating local improvement assessments in EC 7.170 and 7.175. E. On February 2, 2010, a public hearing on the ordinance, as required by Section 28(2) of the Eugene Charter of 2002, was held before the hearings official as authorized by EC 2.007(4) and 7.187. More than ten days prior to the scheduled public hearing before the hearings official a, notice containing the information required by EC 7.185 was posted on a public bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment. The hearings official considered the assessment report of the City Engineer and Finance officer and the testimony and evidence presented at the hearing. F. At least ten working days prior to the Council meeting, notice of the Council's consideration of this Ordinance was published in the Register Guard, and the ordinance was posted on the City's web site on the same date, as required by Section 28(1) of the Eugene Charter of 2002. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings official's findings and summary, and based thereon, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1 . The hearings official's summary is made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with EC 7.160 to 7.194, attached as Exhibit B, which is incorporated herein by reference, are adopted. Section 2. The actual assessable cost of the local improvement comprised of paving, and constructing curbs, gutters, sidewalks, street lights, stormwater drainage, water quality facilities, on Elmira Road from Bertelsen Road to Maple Street and on Maple Street from Elmira Road to Roosevelt Boulevard is $617,689.06,, which is - assessed against the parcels of property hereinafter described on Exhibit C in the amounts set, opposite, respectively. Section 3. The City Council hereby determines and assesses each lot and part of lot within the described local improvement district as set forth on the assessment roll attached as Exhibit C, which is incorporated herein by reference. Section 4. The City Council hereby determines that each parcel of land or, lot described above is specially benefited to the extent of the assessment set forth. The Finance Officer shall give notice of the assessments to the owners of the assessed parcels and inform them that the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the tern day period are declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be paid, with interest on the unpaid principal amount commencing ten days after the effective date of this ordinance: 4.1 In up to thirty semi - annual installments, including principal and interest at the rate set by the City Manager as provided in EC 2.022 through 2.024. 4.2 If the property owner so elects, up to 180 monthly installments, including principal and interest at the rate set by the City Manager as provided in EC 2.022 through 2.024 plus a service charge determined by the City Manager as provided in EC 2.020. Section 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment containing the following: 5.1 A description of each lot, part of lot or acreage specially benefited by the local improvement; 5.2 The name of the owner or reputed owner thereof, or that the name of the owner is unknown; and Ordinance Page 2 of 3 5.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. Section 6 . Upon enactment of this ordinance, the City Finance officer shall send notice of the assessments by first class mail to the owners of the assessed parcels containing the information required by EC 7.190 and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Section 7. Any assessment remaining unpaid and for which no application for installment payments has been received may be foreclosed as provided by law. The proceeds from the payment or foreclosure of assessments levied by this ordinance shall be deposited to the city funds which advanced the cost of construction, engineering and related expenses or which are used to retire any indebtedness incurred by the City for this improvement. Section 8. An immediate effective date of this Ordinance is necessary to allow the City to begin immediate collection of the assessments that will be used to pay the obligations the City has incurred for this project. Enabling the City to begin collecting assessments will avoid increased interest costs and conserve limited City resources. Therefore, this Ordinance shall become effective immediately upon its passage by the City Council pursuant to Section 32(2) of the Eugene Charter of 2002. (JOB #4275) (CONTRACT 2009 -15) BACKGROUND The background of this project is discussed extensively in the Memorandum from the City Engineer. The Hearings Officer finds that adequate and incorporates that discussion by reference. PROJECT The proposed project will consist of paving a 24 foot wide street and the improvements associated with such an improvement. The project is described in the Memorandum from the City Engineer. ASSESSMENT Costs were distributed as required by the Eugene Code, section 7.175, and outlined in the Council adopted Hearings Official findings and recommendations and resolution forming the Local Improvement District. Below are the final assessable unit costs: Paving 10 -foot (per front foot) $ 72.08 Parking Bays on Maple Street (each property) $ 422.62 Sidewalk and drive aprons. (per square foot) $ 3.75 Total Assessable Cost $ 617,689.06 Total City Cost: w/o Low Income Subsidy: $ 2,033,538.77 Low Income Subsidy $ 228 Advance -pay equivalent assessments $ 23,126.36 Delayed assessments $ 16 Total Project Cost $ 2,919,363.70 At the time of the formation of the LID, based on the bids received, an estimated assessment cost was presented to the Council. These estimates were higher than the final proposed assessment. PROPOSED FINAL ASSESSMENTS FOR ELMIRA ROAD AND MAPLE STREET Page I Paving 10 -foot (per front foot) $ 104.00 Parking Bays on Maple Street (each property) $ 550.00 Sidewalk and drive aprons (per square foot) $ 4.30 Total Assessable Cost $ 1,201,560 Total City Cost: w/o Low Income Subsidy: $ 2,089,800 Total Project Cost $ 3,291,360 The decrease in the proposed assessments came from project savings and the Council decision to apply budgeted funds saved by the low bids to the assessable costs of the project. Pursuant to City Code, the City is paying the largest share of the project costs. The city share of the costs includes the cost of the extra width (beyond 10 feet of paving) of the collector street. In addition, the street light improvements, street trees and larger capacity stormwater drainage improvements are paid for by the City because this is a collector street improvement. On this project the existing wastewater pipes needed to be adjusted to avoid conflict with the new stormwater drainage system and this work is funded out of the Wastewater Utility Fund. Only the standard five -foot width of the sidewalk is proposed to be assessed. Some improvements to the bike path connections from the neighborhood to the Roosevelt Path were paid for by the City. The City is also responsible at this time for the cost of the delayed assessment of large lots. Lots that have more than 100 feet of front footage are only assessed for the first 100 feet of frontage. Based on the assumption that these lots may develop more in the future, the assessment of the additional frontage is not done at this time, but is delayed until the time when the property divides or further develops. This helps reduce the pressure for the division of these large lots that would otherwise be increased by the large assessment. Low INCOME SUBSIDY Of the 122 properties in the LID, owners of 48 properties qualify for a subsidy under the low -to- moderate income subsidy program. This City funded subsidy program is available to property owners who occupy a single family dwelling or duplex and meet other program criteria. The income levels for the subsidy program are based on the current Lane County Median Family Income. The total cost for the low income subsidies is $228,722.84. PUBLIC INVOLVEMENT This project was initiated by the Council. Since that initiation, City staff` have had multiple interactions with property owners within the area of the project, including a meeting in January to PROPOSED FINAL ASSESSMENTS FOR ELMIRA ROAD AND MAPLE STREET Page 2 discuss the proposed assessments. A final hearing on the proposed assessments was held on February 2, 2410. The minutes of that hearing are attached as Exhibit A. In addition, one property owner, LANCO Investments, has written a letter "rejecting" the assessments. The property owner claims that the property was purchased in the summer of 2009, probably after the formation of the local improvement district. Their objection stems from the claim that access to the property is blocked by a utility pole and guy wire in the public right of , way. The objection is not timely. The previous owners of the property had signed an irrevocable petition for the assessments, and had not raised any objection to the calculation that this particular property was benefitted by the improvement at the time the local improvement district was formed in 2009. In addition, it is not clear from the evidence submitted by LANCO Investments that the access to their property is actually blocked by the utility pole. The photographs suggest instead that the problems with access, if there are any, actually come from encroachments by the abutting property onto the panhandle portion of the property in question. The Hearings Official does not recommend any modification of the proposed assessments because of this objection. FINDINGS AND RECOMMENDATION Notice of the public hearing was provided and all the property owners were given an opportunity to participate in the hearings. Appropriate notice was given of the public hearing and pending Council action, as required by the Eugene Charter and Code. Letters informing property owners of the hearing and notification to property owners of the intent of the City to characterize the assessment as an assessment, not a tax, as required by ORS 305.583(5) were mailed to the property owners. The Hearings Officer finds that the project is one for which the assessments are for local improvements as set forth in ORS 310.410 because 1. The assessments do not exceed actual costs; 2. The assessments are imposed for a capital construction project that provides a specific benefit for a specific properly or rectifies a problem caused by a specific property 3. The assessments are imposed in a single assessment upon completion of the project; and 4. The assessments allow the property owners to elect to pay the assessment with interest over at least ten (10) years. The Hearings Official also finds that the proposed final assessment, calculated and recommended by the City Engineer is reasonable and consistent with the Eugene Code. The Hearings Official recommends that the Council act in accord with the City Engineer's recommendations, adopting PROPOSED FINAL ASSESSMENTS FOR ELMIRA ROAD AND MAPLE STREET Page 3 the ordinance prepared for the public hearing, levying the assessment as set forth by the City Engineer. Respectfully submitted, Milo Mecham Hearings Official February 5, 20 10 PROPOSED FINAL ASSESSMENTS FOR ELMIRA ROAD AND MAPLE STREET Page 4 Ms Cahill described the project as including the installation of 24 feet of paving improvements on the streets, as well as sidewalks and the associated curbs and gutters and street lights. At the request of property owners along Maple Street, parking bays were installed. Instead of installing bike lanes, the sidewalk is slightly larger than the standard size. Signs have also been installed directing bikers to the nearby bike path. Principal Engineer Cahill also described the method of determining the assessments. The cost of the improvements was divided between the portion that the City would pay and the portion to be assessed to the property owners. After this division was made, the costs for each property owner were divided according to the directions of the Eugene Code. Also in accord with the instructions of the Code, residentially zoned and developed properties with greater than 100 feet of frontage along the street were subject to a delayed assessment, where that part of the frontage greater than 100 feet was not assessed, and would not be assessed until such time as the property was - divided or otherwise further developed. ' Ms Cahill also described the City program for low income subsidies, which 48 property owners applied for and appear to be qualified for at this time. The proposed final unit costs are much lower than was originally projected. For the assessed ten feet of street for each property, the cost was $72 per foot, down from a projected unit cost of $104 at the time the LID was formed. The costs for sidewalks and drive aprons was also reduced. The only attendee to speak was Mr. Ron Johnson. Mr. Johnson had begun his remarks and questions before the hearing commenced. Prior to the hearing Mr. Johnson had begun by asking if his assessment included the portion of his property that was occupied by utility boxes. Ms. Cahill and Mr. Bonham checked the maps and assessment records and confirmed that the property where the utility pole was located was on the deed records as being part of Mr. Johnson's property and was therefore being assessed. Mr. Johnson also expressed his personal difficulties in paying the assessment at this time. He indicated that he was a construction contractor and, like other general contractors, had been hard hit by the recession. Ms. Cahill discussed the possible payment options with Mr. Johnson. The Hearings official asked if Mr. Johnson might qualify for any of the low income subsidies. It turned out that the property did not qualify because it was not owner occupied, since Mr. Johnson had purchased the house for his daughter and son -in -law to live in. Mr. Johnson is not a resident of Eugene. There was a discussion of the interest rate for financing the project. Mr. Johnson expressed his concern about the eight percent interest rate described in the financing information. Ms. Cahill clarified the situation. Eight percent was previously identified as the interim rate, charged until the time that the City is able to sell bonds and set a final rate. In June the City Council agreed to the interim rate being indexed closer to market so we anticipate it will be lower for these proposed assessments. The final rate is usually lower than the interim rate. The City cannot quote the final rate because it is the rate fixed by the sale of bonds, which does not happen until after the assessments are made. After the commencement of the hearing Mr. Johnson asked additional questions. His first question was to ask why the improvement had not been made to Elmira all the way through to Highway 99. Principal Engineer Michel Cahill explained that the portion of Elmira between Maple Street and Highway 99 was not a collector street but was classified as a local street. Ms. Cahill explained that the process for initiating improvements on local streets, such as that portion of Elmira, relied on local property owner requests for the improvements. In this case there had not been sufficient local property owner requests to mare the improvements on the portion of Elmira that was a local street. s Mr. Johnson asked if the process of assessment was common. He indicated that he was unfamiliar with the assessment process and felt that it would be more logical to increase the tax payments of everyone in the neighborhood, and use that money to pay for improvements. Ms. Cahill explained that the Council had made the policy decision that properties that abut an improvement should be the properties that are'assessed to pay for improvements. The hearings officer explained that assessments for local improvements are a common method used by local governments to pay for the improvements. Mr. Johnson asked for the engineers' opinion of the condition of streets in Eugene. City Engineer Mark Schoening explained that there was a backlog of over $100 million of needed improvements and repairs to City streets. Mr. Johnson asked why the City had let the streets deteriorate so badly. Mr. Schoening indicated that much of the problem came from an unchanging revenue source — the state gas tax payments -- and an ever increasing cost of repairs. Mr. Schoening discussed the relationship between the number of improved streets needing repair and the amount of unimproved streets such as Elmira Road had been. The number of unimproved streets is a small percentage of the City's improved streets. Ms. Cahill informed Mr. Johnson that once improved to City standards, the City would tape responsibility for maintenance and would not assess the abutting property owners again. Mr. Johnson indicated that Elmira was originally a county road. Mr. Johnson lives near Veneta, on a county road. It had recently been repaved and was in good condition. Mr. Johnson wondered why after annexation the City had not kept Elmira Road in good condition. City Engineer Mark Schoening indicated that Elmira had not been Dept in good repair by the County, and was in deteriorated condition when it was annexed. Mr. Johnson concluded by asking for an explanation of the financing process. Ms. Cahill responded by saying that the first steps depended on Council approval of the proposed assessments. If this occurs, City Finance will send the assessment statements to the property owners. The property owners will then have ten days to pay the assessment or to elect to finance the assessment. Mr. Johnson again explained that he would have no choice but to finance the assessment because he had been so hard hit by the recession. (JOB #4275) (CONTRACT 2009 -18) s A FIC r The City Council formed the Local Improvement District (LID) for this project on April 13, 2009. Construction of the project has been completed, estimated final costs have been tabulated, and final assessment costs have been calculated. The property owners were notified of the proposed assessments and the pending assessment hearing ten (10) days prior to the hearing as required by Eugene Code. The intent of the final assessment hearing scheduled for February 2, 2010, is to review the final project cost, consider comments on the proposed assessments, and to provide evidence to be included in the ordinance levying the assessments by the City Council. The project was initiated by Council action on April 1 1, 2005, by adoption of the 2006 Capital Improvement Plan and pursuant to Section 7.160(5) of the Eugene Code (EC), 1971. The preparation of plans and specifications and the call for bids for construction of the local improvements are based on Council Action on April, 2005 pursuant to Section 7.160(5) of the Eugene code, 1971. Bids were opened on March 24, 2009, with Morse Bros. Inc. dba Knife River as the low bidder. The property owners were notified of the public hearing regarding formation of the proposed Local Improvement District (LID) and a hearing was held on April 2, 2009. Minutes, Findings and Recommendation from the Hearing Official were forwarded to the Eugene City Council in advance of their April 13, 2009 Formation of the LID. Additionally, on June 22, 2009 the Eugene City Council approved a plan to reduce the assessable costs on three local improvement districts that were formed in 2009. (Crest/Friendly /Story Improvements, Chad Drive Improvements and Elmira Road/Maple Street Improvements were the LIDs that benefitted from lower construction bids and budgeted funds that could be applied to street improvements.) Elmira Road and Maple Street property assessable costs were reduced by approximately $162,500 which resulted in a front foot reduction of almost $17 per front foot. At that same meeting the Eugene City Council authorized modifications to the interim financing rate and the finance period. Property owners who chose City Financing will be able to finance their assessments for up to 15 years. Engineers report for Proposed Final Assessment on Elmira Road and Maple street (Job 4275) page 1 CORRESPONDENCE AND COMMUNICATION Since the mailing of the Notice of Proposed Assessments, City staff received eight phone calls and one e -mail from property owners regarding the process to final assessment, cost calculations, financing of the costs and details about construction. When one property owner received his Notice of Proposed Assessment he called to request a credit for the work he did. He had declined to have a portion (3-4') of driveway beyond the approach constructed by the City's contractor, as is typical for our construction projects. He chose to construct a full driveway improvement (18') himself. The small portion of what the City would have done relative to the full scope of desired work made sense that the property owner do it all himself; no discussion of credit or compensation was made at the time. The City has declined the request for a credit. An open house was held January 28, 2010 and property owners with proposed assessments were invited. Representatives of about 12 properties, or 10% of total properties attended and commented on the project elements, construction, and asked questions about financing, construction and assessment calculations. Generally there was acceptance and some appreciation for the project. As of noon, February 1, 2010, one of the property owners has indicated they will be attending the hearing. No written correspondence has been received. On February 2 we received a certified mailing that included a property owner "rejecting" the assessments because - his vacant panhandle lot is "blocked" by a power pole. There is an irrevocable petition for public improvements on Elmira Road on file for this property and so it has been included in the proposed assessments. The street improvements consist of 24 -foot wide paving. The improvements include, curb and gutters, sidewalks, street lights, parking bays on Maple Street, and storm water drainage system with water quality facilities. The project addressed the deteriorating roadway, improved safety for all modes, provided storm water quality and improved drainage conveyance. As requested by the property owners signage was provided on Elmira Road to alert bicyclists of the nearby Roosevelt Path. This signage was to partially offset not constructing bike lanes with the improvements. The signs are located at intersections on Elmira Road to direct travelers down side streets to the connections to the path. For the curb -side sidewalk a six foot walk was constructed to allow additional safety from the travel lane and lessen conflict with bicyclists on the sidewalk and pedestrians. Street trees will be planted this winter and some modifications to the stormwater quality drainage Swale will still take place in the spring. Some operational issues are still under consideration. These include adding centerline striping and removing the crosswalk closed "hitching post" signs. The front - footage for these lots was included in the computation for the assessable costs but the properties are not included in the proposed assessments. The delayed assessments may be collected later if 4 partially developed lots further develop. These lots are greater than 0.5 acre and have more than 100 feet of frontage; the delayed assessment will be for the front foot greater than 100 feet at a rate based on today's rate but indexed to construction costs. The final assessable costs are lower than estimated when the LID was formed. Per Eugene Code, property owners of low density residential zoning on a collector street were assessed for a portion of the width and structure (depth) of the street, equivalent to a local street. For a neighborhood collector the width is ten -foot of paving. The City pays for the remaining paving costs. In addition, for collector streets, the street light improvements, street trees, larger capacity stormwater drainage improvements, are paid for by the City. on this project the existing wastewater pipes needed to be adjusted to avoid conflict with the new stormwater drainage system and this work is funded out of the wastewater Utility Fund. only the standard five -foot width of the sidewalk is proposed to be assessed. Some improvements to the bike path connections from the neighborhood to the Roosevelt Path were paid for by the City. Property owners of fully developed land zoned single family residential pay for actual frontages with the exception that the maximum is 100 feet and the minimum is 50 feet. - A few properties don't fit in the minimum and maximum range. For partially developed properties over 0.5 acres and front footage greater than 100 feet the property owner is assessed for 100 front feet. If the lot were to further develop a "delayed assessment" would be due for the portion of lot over 100 feet. The criteria for the exceptions include evaluating the zoning, land use, lot size, level of development and frontage. The criteria would have a vacant lot or fully developed lot more than % acre be assessed a minimum of 50 feet and a maximum of 100 feet. The criterion does not explicitly talk about a partially developed lot less than %2 acre. The Eugene City Council agreed at the formation of the LID that the same minimum and maximum be applied for partially developed lots less than 1/2 acre. The property at the corner of Elmira Road and Maple Street that has frontages on the collector portion of Elmira and the local street portion of Elmira. The portion of the property that receives the improvements that include the paving, curb, gutter and sidewalk will be assessed for the actual frontage of curb and gutter improvements. When the local section of Elmira is improved to urban standards the remaining frontage would be assessed. r In addition there are 24 properties without primary access to Elmira Road and two on Maple Street. Seven of'these have irrevocable petitions signed when the property was developed and are included in the assessments. The remaining properties have addresses on the side streets and some already are served by curb and gutter and were assessed when their local street frontage was improved to urban standards. The non - assessable City share for this project is funded from Transportation SDC and Stormwater SDC and wastewater Utility Funds. Assessment. financing, up to a 15 -year payment plan through the City, is available to all property owners within the improvement district as identified by Eugene Code, Chapter 7. In addition there are extension or deferral programs for qualifying property owners. Based on the low bid received, the costs listed below are the estimated assessment costs plus contingency calculated at the time, of the formation of the LID. Paving 10 -foot (per front foot) $ 104.00 Parking Bays on Maple Street (each property) $ 550.00 Sidewalk and drive aprons (per square foot) $ 4.30 Total Assessable Cost $ 1,201,560 Total City Cost: w/o Low Income Subsidy: $2,089,800 Total Project Cost $ 3,291,360 LOW INCOME SUBSIDY Of the 122 properties in the LID, owners of 48 properties qualify for a subsidy under the low -to- moderate income subsidy program. This City funded subsidy program is available to property owners who occupy a - single family dwelling or duplex and meet other program criteria. The income levels for the subsidy program are based on the current Lane County Median Family Income. The total cost for the low income subsidies is $225,722.84. RECOMMENDATION Assessment costs are calculated in accordance with Eugene Code. Staff recommends approval of the final assessments as calculated, and that the Council levy the final assessment.
