Home My WebLink AboutAdmin Order 53-10-05-FADMINISTRATIVE ORDER NO. 53- 10 -05 -F of the City Manager of the City of Eugene AMENDMENT OF THE LAND USE APPLICATION FEE SCHEDULE ESTABLISHED BY ADMINISTRATIVE ORDER NOS, 53- 05 -08 -F 53-07 - 11 -F AND 53- 09 -03 -F TO ADD A FEE FOR DESIGN REVIEW. The City Manager of the City of Eugene finds as follows: A. Section 2.020 and the provisions of Chapter 9 of the Eugene Code, 1 971, authorize the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. B. In accordance with the above provisions, land use application fees have been established by Administrative Order No. 53-05 -08 -F, and amended by Administrative Order- Nos. 53 --07 -1 I -F and 53- 09 -03 -F. C. The City Council recently adopted Ordinance No. 20460 establishing the 'Walnut Station Special Area Zone which became effective on August 14, 2010. On September 2, 2010, Administrative Order No. 53 -10 -05 was issued proposing to amend the Land Use Application Fee Schedule by adding a fee for Design Review, an application type that was established by Ordinance No. 20460 for use within the Walnut Station area. The Design Review fee is based on the actual costs incurred by the City in processing similar applications in an effort to recover costs involved with implementation of the provisions adopted by Ordinance No. 20460. D, Notice of the proposed amendment was provided to the Mayor and City Councilors, to persons who had requested such notice, and was made available for inspection by interested persons at the Planning & Development Department, Planning Division, 99 West 10 Avenue, Eugene, Oregon, during normal business hours. Notice was also published in the Register -Guard Newspaper and posted at two locations at City Hall on September 8, 2010. E. The Notice provided that written comments would be received for a period of 15 days from the date of publication and posting, or at the public hearing to be held on September 15, 2010, at 5:00 p.m. in the Sloat Conference Room, 99 west 10 Avenue, Eugene, Oregon. There were no attendees at the public hearing, nor were any comments submitted within the time or in the manner required by the Notice. F. Based upon the above findings, and the findings in Administrative Order No. 53- 10-05 I find that the Design Review fee should be established as proposed. In addition, staff has recommended that the Land Use Application Fee Schedule be reformatted and updated to remove fees that are no longer in effect. I concur with staff's recommendation. In determining the fees, I have considered the applicable policies, enactments and directives of the City Council, the amount charged for these services by the City in the past, the full costs of providing the services supported by the fees, the amounts charged by other comparable providers, and the revenue needs of the City as determined by the adopted City budget. On the basis of these findings, I order that: 1. As of the effective date of this Order, the Land Use Application Fee Schedule is amended by adding a fee for Design Review to Section A--1 of the fee schedule. 2. The unamended fees established by Administrative order Nos. 53- 05 - -F, 53- 07 -1 I -F and 53-09 -03 -F remain in full force and effect and are incorporated into the Land Use Application Fee Schedule attached as. Exhibit A to this Order. The attached fee schedule has been reformatted and updated to remove fees that are no longer in effect. Dated and effective this 18 day of October, 2414. Jon R.
