ISSUE STATEMENT
There are currently two vacancies on the City of Eugene Toxics Board. One vacancy is for Position 1, an
industry position, and the other is for Position 6, an advocacy position. The City received two
applications for the industry position, and one for the advocacy position. The Toxics Board has now
interviewed all three applicants, and recommends appointing David Beede to Position 1, and Randall
Prince to Position 6.
BACKGROUND
The Eugene Toxics Right-to-Know Program was created and is governed by Section 54 of the Eugene
City Charter, adopted by citizen initiative in November, 1996. It requires that businesses meeting
certain criteria report their hazardous substance use to the City, that the City make that information
public, and that hazardous substance users pay fees as necessary to operate the program.
To be required to report and pay a fee, a business must: a) be a manufacturer (i.e., have a Standard
Industrial Classification in the 2000s or 3000s); b) operate a stationary facility within the Eugene city
limits; c) have 10 or more full-time equivalent employees during the course of a calendar year; and d)
have total inputs of reportable hazardous substances of more than 2,640 pounds in a calendar year.
The program requires the Fire Marshal’s Office to perform certain duties (investigations, audits, etc.),
and is overseen by a seven-member, appointed, citizen board that is empowered to provide policy
direction and advise the City Council.
The Eugene Toxics Right-to Know Program relates to the following Eugene City Council Goals and
Outcomes: Safe Community; Sustainable Development; and Effective, Accountable Municipal
Government.

COUNCIL OPTIONS
1.Appoint David Beede to Position 1, and Randall Prince to Position 6.
2.Decide not to appoint David Beede to Position 1, and Randall Prince to Position 6, and provide other
direction.
CITY MANAGER’S RECOMMENDATION
The City Manager and the Eugene Toxics Board recommend the appointment of David Beede to
Position 1, and Randall Prince to Position 6 to the Eugene Toxics Board.
SUGGESTED MOTION
Move to appoint David Beede to Position 1 on the Eugene Toxics Board, to the unexpired term of
Maeve Sowles, ending June 30, 2013.
Move to appoint Randall Prince to Position 6 on the Eugene Toxics Board, to the unexpired term of
Elizabeth Weaver, ending June 30, 2012.
