HomeMy WebLinkAboutAdmin Order 58-04-09-F ADMINISTRATIVE ORDER NO. 58-04-09-F of the City Manager of the City of Eugene ADOPTION OF INDEXING OF EQUIVALENT ASSESSMENT RATES ADMINISTRATIVE RULE R-7.407. The City Manager of the City of Eugene finds as follows: A. Section 2~019 of the Eugene Code, 1971, authorizes the City Manager to adopt vales and regulations necessary for the administration or enforcement of provisions of the Eugene Code, 1971. B. Pursuant to that authority and based on the findings contained in Administrative Order No. 58-04-09 issued on March 15, 2004, I proposed the adoption of Indexing of Equivalent Assessment Rates Administrative Rule R-7.407. C. Notice of the proposed Rule was given by making copies available to any person who had requested such notice and by publication in the Register Guard, a newspaper of general circulation within the City, for five consecutive days, on March 19, 20~ 21, 22, and 23, 2004. The Notice provided that written comments would be received for a period of 15 days from the date of the first publication. No written comments were received within the time or in the manner set forth in the Notice. Now, therefore, based on the above findings and the findings in Administrative Order No. 58-04-09, which are hereby adopted, and pursuant to the authority contained in Sections 2.019 of the Eugene Code, 1971~ [ hereby adopt Indexing of Equivalent Assessment Rates Administrative Rule R-7.407, to become effective as of 12:01 a.m. on April 12, 2004, as follows: INDEXING OF EQUIVALENT ASSESSMENT RATES ADMINISTRATIVE RULE R-7.407 R-7.407-A Definitions. As used in this Rule, the following words and phrases are defined as follows: Base Year. The year when construction of the improvement was commenced. CCL Construction cost index. Administrative Order - 1 City Engineer. The person so designated bythe City Manager of the City of Eugene, or his or her designee. ENR. Engineering News Record. R-7.407-B Equivalent Assessment Rates. An equivalent assessment imposed under Section 6.476 or 7.407 of the Eugene Code, 1971, shall be based on the following methodology and formula: 1. Methodology. Index the original construction cost by the 20-city construction cost index (CCI) as published in the Engineering News Record (ENR). 2. Formula. CC][ from December of previous year x original construction cost CC][ from December of base year. The rates established pursuant to the above Methodology and Formula shall be updated annually, on or about April 1, based on the ENR CC][ rates from December of the previous calendar year. R-7.407-C Implementation. The equivalent assessment to be charged for land divisions shall be calculated using the rates in effect at the time of final plat approval. For building permit applications, the equivalent assessment to be charged will be calculated using the rates in effect on the date a permit application is accepted as complete at the Permit Center. R-7.407-D Review of City Engineer's Determination. Amy person ag~ieved by the City Engineer's determination of an equivalent assessment under Sections 6.476 or 7.407 of the Eugene Code, 1971, may seek a review of the determination before a hearings officer within the time and in the manner provided in Section 2.021 of the Eugene Code, 1971.
