HomeMy WebLinkAboutAdmin Order 21-03-12 ADMINISTRATIVE ORDER NO. 21-03-12 of the City Manager City of Eugene, Oregon RESCINDING ADMINISTRATIVE ORDER NO. 58-92-21 AND RE-DELEGATING DUTIES TO THE EXECUTIVE DIRECTOR OF THE PUBLIC WORKS DEPARTMENT. The City Manager of the City of Eugene finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the City Manager was designated as the administrative head of the City, was specifically authorized to appoint and remove all employees (except as otherwise provided in the Charter), organize, disband, or reorganize City departments, and to enforce all ordinances of the City. (The same authorizations are contained in Chapter IV, Section 16 of the Eugene Chaxter of 2002, subject to the limitations contained therein.) Pursuant to that authority, in 1992 the City Manager reorganized the Public Works Department and Parks, Recreation and Cultural Services Department (PARCS), with many of the functions, duties and responsibilities previously performed by the PARCS Department becoming the function, duty or responsibility of the Public Works Department. B. At that time Sections 2.812 to 2.817 of the Eugene Code, 1971 (ECL authorized or required specific duties or acts to be performed by the person designated by the City Manager as the Executive Director of the Parks, Recreation and Cultural Services Department, and EC Section 4.330 authorized the City Manager or designee to designate areas within City parks where dogs may be allowed to run off leash. C. On November 30, 1992 the CityManager issued Administrative Order No. 58-92-21 designating the Executive Director of the Public Works Department as the person to carry out the duties and responsibilities referenced in finding B above, and rescinding any prior orders in conflict therewith. D. Although EC Sections 2.812 to 2.817 were repealedbyOrdinance No. 20015 onMay 22, 1995, subsequent administrative orders of the City Manager have confirmed the continuing authority delegated by Administrative Order No. 58-92-21. E. Due to the passage of time and the limitations on access to EC Sections 2.812 to 2.817, the a~Ithority delegated in Administrative Order No. 58-92-21 should be reaffirmed and the duties and responsibilities re-delegated as set forth herein, with that order rescinded as of the effective date of this Administrative Order. Now, therefore, based upon the above findings, which are hereby adopted, The City Manager of the City of Eugene orders and directs that: 1. Administrative Order No. 58-92-21, is hereby rescinded, as of the effective date of this Administrative Order. 2. Subject to the authority and control of the City Manager and any limitations imposed Administrative Order - 1 C \WINDOWS\Temporary Interact Fdes\OLKA385\03cmopubwks2 wpd(08/25/03) by the Eugene Code, 1971, the Executive Director of the Public Works Department is hereby authorized to: 2.1 Regulate and supervise the administration, acquisition, maintenance, use and operation of areas designated as city parks, park lands, recreation areas, open space areas, city buildings~ and such other properties as may be assigned by the City Manager; 2.2 Protect city park and open space visitors, resom'ces, facilities, and the environment of City parks, open space, and recreation areas; 2.3 Adopt tales and regulations regarding the use of park and open space areas and facilities, including the determination of appropriate activities, designating off-leash dog areas, time of use, and access to areas and facilities, in the manner provided in EC Section 2.019; and 2.4 Perform such other duties designated in the Eugene Code, 1971, or assigned by the City Manager. The Executive Director of the Public Works Department is specifically authorizcd to in turn delegate any of the duties or responsibilities delegated herein upon a determination that it would be more efficient and in the public interest to do so. Nothing contained herein shall affect the validity of any actions taken or rules adopted pursuant to the authority of Administrative Order No. 58-92-21, nor the authority delegated to the Library, Recreation & Cultural Services Executive Director by Administrative Order No. 57-95-01 of the City Manager, which are hereby ratified and affirmed.
