City Manager of the City of Eugene
INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT
CHARGES FOR LOCAL WASTEWATER SYSTEM,
TRANSPORTATION SYSTEM, AND STORMWATER SYSTEM; AND
REPEALING ADMINISTRATIVE ORDER NO. 58-08-02-F-0
The City Manager of the City of Eugene fords as follows:
A. Section 2.020 of the Eugene Code, 1 971, authorizes the City Manager of the City
of Eugene to determine and set fees and charges to be imposed by the City for services, goods,
use of municipal property, and licenses and permits. Section 7.710(5) of that Code authorizes the
City Manager to adopt by administrative order inflationary adjustments to Systems Development
Charges (SDC) based on previously adopted rate factors and cost indices. Section 2.4 of the
SDC Methodologies authorizes the City Manager to adopt fee changes, based on a cost index or
rate factors, by administrative order pursuant to Section 2.020 of the Eugene Code, 1971, so long
as the fees are not revised administratively in an amount greater than five percent within any 12-
month period.
B. The SDC Methodologies were adopted by Resolution No. 4900 on April 9, 2007,
and have subsequently been amended, most recently by Resolution No. 4998, which became
effective on April 1, 2010.
C. SDCs for Local Wastewater System, Stormwater System, and Transportation
System were adjusted for inflation by Administrative Order No. 58- 08 -02 -F, effective April 3,
2008; however, that Administrative Order has been superseded by Resolution No. 4998 which
adopted inflationary adjustments to SDCs for . Parks System, Local Wastewater System,
Stormwater System, and Transportation System.
D. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the
Eugene Code, 1971, on March 3, 2011, I issued Administrative Order No. 58 -11 -01 proposing to
implement a 3.5% inflationary increase to the Local Wastewater System, Transportation System,
and Stormwater System as shown on Exhibit A to that Order. The proposed inflationary
adjustments were based on the 20 -city national average Construction Cost Index as published by
the Engineering News- Record and will not result in a five percent or greater fee revision within a
12 -month period.
E. Notice of the - proposed inflationary adjustments was given by providing an
informational memo to the Mayor and Council and making copies of Administrative Order No.
58- 11 -01, including Exhibit A (the proposed amendments) and Exhibit B (the Notice) available
for inspection by the Mayor and City Councilors and by interested persons at the office of the
City Engineer, Public Works Department, 99 E. Broadway, Suite 400, Eugene, Oregon; and by
Administrative Order - Page t of 8
posting those documents at two locations at City Hall on March 11, 2011. These documents
were also made available at the City's internet site on March 11, 2011. In addition, on March I I,
2011, Exhibit B (the Notice) was published in the Register -Guard and persons who requested
notice of amendments were mailed informational postcards as notification of the proposed
amendments.
F. Notice provided that written comments would be received for a. period of 15 days
from the date of posting and publication. Eight comments were received in response to the
proposed amendments. A summary of the comments and my response to the comments are as
follows:
Comment 1 : Boyd Iverson believes that the rate increase is not justifiable or
warranted since there has been no increase in the consumer price index. Also, the
construction industry and home ownership have been hit harder than- any other industry
or group of people and it is audacious for the City to propose a 3.5% increase to the cost
of home ownership. The City should take the time to think about the effect the increase
will have on an industry that is already severely crippled and a group of people (home
owners and potential homeowners) that do not need additional, unneeded and unjustified
expenses being added to their burden.
Response In accordance with the adopted Eugene SDC methodologies, SDC
fees and credits may be periodically adjusted to account for changes in construction costs
and system valuation. The City's adopted cost index used to adjust SDCs is not the
Consumer Price Index (CPI), but rather the 20 -city national Construction Cost Index
(CCI) as published by the Engineering News - Record (ENR). The CCI has increased. The
result of the proposed +3.5% adjustment to the transportation, local wastewater, and
stormwater SDC rates will bean overall increase of approximately +1.18% (or $105.87)
in the total SDCs collected for an average single - family home.
In response to this comment, the effective date of this administrative order has
been postponed to June 1, 2011. In the near future, City staff will be proposing that the
City Council adopt a resolution that reduces the park SDC rates. The proposed effective
date for that Council resolution will be June 1, 2011. If Council adopts the proposed park
SDC rates reduction; that rate adjustment together with this administrative order's 3.5%
rate increase will result in an overall reduction in the amount of SDCs currently collected
for the average single - family home. Specifically, if .Council approves City staff s
recommendation to reduce the parks SDC with the June 1, 2011 effective - date, the total
SDCs collected for an average single- family home will be approximately -0.98% or -
$88.15 less than is currently collected in SDCs.
Comment 2 : Jordan Iverson states that he is a local, small builder, born and
r4ised in Eugene. The recent economy has obviously been a huge struggle and he is
saddened and hurt that, during this time, there would be another increase in fees. Even
$15 and $ 5 line items in his projected construction costs are having to be taken out. He
notes that ever dollar counts right now and this fee increase will hurt him, his family, his
business, all of the subcontractors, and the limited number of home buyers looking for

new construction. He requests that, at least, the tinning of this amendment be
reconsidered.

this community has, and continues to endure. Proposed adjustments scheduled in 2009
for local SDC rates and related SDC administrative fees were delayed until calendar year
2010 to provide relief to the development community. There are a couple of down -sides
to the delay of periodic construction cost adjustments, one being that when the new rates
are finally adopted they reflect a longer rate adjustment time period and result in higher
spires in actual adjustment rates when implemented than if they had been adjusted over
shorter periods of time. The other down side is that the planned public infrastructure
projects to be funded, fully or in part, by SDC revenues are delayed.

been delayed to June 1, 2011. This June 1, 2011, effective date will correspond with the
effective date of the reduction to parks SDC rates that City staff will be proposing to the
City Council. If Council adopts the proposed park SDC rates reduction, that rate

Comment 3 : Bruce Wiechert voiced his concern regarding the proposed SDC
increases. He opined that this is an absolutely impossible time to be increasing
development costs. with real estate prices tumbling, he is one of the last builders still
building and wants to go on the record as adamantly opposing the proposed increase.. He
stated that other methods must be found to reduce the City's increase in costs. , He felt
that the proposed amendments might just be a technique to squeeze more funds from the
private sector. He believed that the City should be instituting cost reduction measures for
the building sector not increasing the cost.
,Response Systems development charge revenues fund capital infrastructure
projects that meet the capacity demands of new development. The City continuously
strives to mare capital project more cost- effective; however, construction costs in general
tend to increase over time due to changes in material and labor costs. In accordance with
the adopted Eugene SDC methodologies, SDC fees and credits may be periodically
adjusted to account for changes in construction costs and system valuation. The City's

Comment 4 : Gordon Anslow suggested that the SDC increases not go forward.
He has been involved in the home building industry continuously since 1970. The
current downturn in residential construction is not just another garden variety hiatus of
work as with previous recessions. Since the 1950s, housing costs have been going up, as
have new regulatory expenses affecting all aspects of homebuilding. The added costs
have always been borne due to healthy demand and relatively high employment levels.
Due to new rules, codes and expenses, housing that is affordable to working Americans
can no longer be built. As a result, people remain in older, substandard housing, thus
making older, substandard housing more valuable, and increasing the chance that it will
not be replaced. If new construction becomes so expensive that little or no construction
occurs, there will be no new work on which to charge SDCs, and the end result may be
less money collected on SDCs than if the rates had not increased. He would like to see
SDCs abolished so that affordable housing could be a reality again. However, at a
minimum, SDCs should not increase at this time.
Response City Council adopted growth management policy no. 14 states,
"Development shall be required to pay the full cost of extending infrastructure." The
only exception to this policy is an exemption from assessment of local SDCs for
proposed housing for low - income persons that meets criteria outlined in Eugene Code
7.725(c). SDCs are an important funding component of planned public infrastructure
projects that fully, or in part, will provide capacity for new growth anticipated in this
community over a multi -year planning period to "build -out" of the current Eugene Urban
Growth Boundary.

No changes are being made to the SDC rates as a result of this comment.
Comment 5 : Wade Fletcher stated that every time there is an SDC increase, it is
always passed on to the faceless consumer. He would like to assist the City with
educating the public on what SDC's are, how they are calculated, and the process for
raising rates. He wants to do this in a way that would spark interest and maintain
attention.
Response: In accordance with the adopted Eugene SDC methodologies, SDC
fees and credits maybe periodically adjusted to account for changes in construction costs
and system valuation. The City's adopted cost index by which to adjust SDCs is the 20-
city national Construction Cost Index (CCI) as published by the Engineering News-
Record (ENR). The adoption method depends upon the magnitude of change
(up or down) being proposed. Per our adopted methodologies document, the City
Manager may adopt fee changes (based on an adopted specific cost index) by
administrative order so long as the fees have not been revised administratively in an
amount greater than five (S) percent within any 12 -month period. If the magnitude of
change is greater than 5 %, then the proposed adjustment is processed via a Resolution
that is considered by City Council which may opt to hold a public hearing.
Extensive information about SDCs collected by the City of Eugene is available at

the City's Permit & Information Center, 99 West 1 0th Avenue, Eugene OR 97401; or call
(541) 682 -8400. In addition, interested persons may also request to be notified of
proposed changes to Eugene SDCS and/or periodically visit the referenced SDC web
page for updates. SDC information is also provided in the Fee Estimating Guides
published by the Building and Permit Services Division and available at www.eu
or.gov/bldgperrnitfees.
No changes are being made to the SDC rates as a result of this comment.
Comment 6: Eric Hall is concerned With the latest proposed increase and
doesn't believe there is any market -based justification for an increase in the SDC fees
currently being charged. He has seen construction fees, wages and most materials remain
relatively stable or decline, and design and engineering fees have decreased. He feels
that over the next five years, any growth will likely be very modest, resulting in few

increases in the number of users of the system infrastructure. Those few increases of
users probably would not offset the decreases in the system usage from other properties
that are vacant and that are underutilized. The increase in SDCs isn't warranted or
advisable in this economic climate.
Response: Per the most recent (2009) Annual Population Report published by
Portland State University's Population Research Center, the average population growth
rate in Oregon between 2000 and 2009 is 1.2 %. Eugene's growth rate over that time
period is 13.9 %. while the Report acknowledges that Oregon's growth rates have tended
to be lower during a recessive economy, migratory inflows have continued to be positive
over the previous decade in spite of high Oregon unemployment rates. Oregon's (and
Eugene's) public infrastructure is certainly being used by an increasing population.
SDCs are an important funding component of planned public infrastructure
projects that fully, or in part, will provide capacity for new growth anticipated in this
community over a' multi -year planning period to "build -out" of the current Eugene Urban
Growth Boundary. Staff and contracted expert consultants strive, to every extent possible,
to develop system methodologies with cost bases founded upon technical merit that
includes consideration of population growth and future infrastructure needs over a
planning horizon much longer than one of, say, five years. This develops a rate based
upon a growth trend over a long period of time as opposed to one that reflects spikes up
and down over shorter time periods and which reflect more acutely the effects of global
recession upon the local economy. while there have been instances recently of final
construction costs coming in lower than initial project estimates, this again simply
reflects a relatively small cause /effect within a much larger window of consideration.

Comment 7 : Mark Lawrence is opposed to the proposed increases and feels that
now is not the right time for such increases because it will only help further suppress the
home building and construction industry by making housing even less affordable than it
already is in the City of Eugene. He states that the developers, builders and contractors
can no longer afford to absorb these costs without passing them along to their clients.
Such an increase at this time is only counterproductive and will only help in drying up
what little construction activity there is in Eugene.

Comment 8 : Lori and Mike Butler have been building homes in Lane County
for over thirty years and this year were forced to lay off employees that have been
associated with them for twenty years. Their goal is to get these people back to work, in
many cases back to work in the only thing they know. Now, they are shocked at the
City's plans to increase SDCs when the area has been in a deflationary environment.
They ask that the increase be deferred for a twelve month period of time to allow for the
economy to show some improvement.

effective date of this administrative order has been delayed to June 1, 2011. This June I ,
2011, effective date will correspond with the effective date of the reduction to parks SDC
rates that City staff will. be proposing to the City Council. If Council adopts the proposed
park SDC rates reduction, that rate adjustment together with this administrative order's
3.5% rate increase will result in an overall reduction in the amount of SDCs currently
collected for the average single - family home. Specifically, if the Council approves City
staff s recommendation to reduce the parks SDC with the June 1, 2011 effective date, the
total SDCs collected for an average single- family home will be approximately - 0.98% or
- $88.15 less than is currently collected in SDCs.
G. I have considered the public comments, applicable policies, enactments and
directives of the City Council, the amount charged for these services by the City in the past, the
full costs of providing these services supported by the fees, the amounts charged by other
comparable providers, and the revenue needs of the City as determined by the adopted City
budget. I find that the inflationary adjustments to the Systems Development Charges set forth in
Exhibit A are consistent with adopted policies of the City, in conformity with applicable state
law, authorized by EC 7.710(5), and should be implemented effective June 1, 2011.
On the basis of these findings, I order that:
1. The adjusted Systems Development Charges as set forth in Exhibit A attached to
this order are effective June 1, 2011.

Local Wastewater System Development Charge Analysis
*The unit cost of capacity for the local wastewater system is $2.9373 per gallon per day.
The flow per Plumbing Fixture Unit (PFU) is stated as gallons per day based on the size of development and type of land use
Land use types that do not fit into the above categories will receive a default flow assignment based on the sample average.
The default flow is 47.93 gal /day x $2.9373 = a cost per PFU of $140.78.
A rate per PFU may be assigned by the City Engineer should a proposed use not be represented by one of the published SDC use
codes and for which a default flow assignment is not representative of the proposed flow. In the case of those proposed developments
that are determined to have a potential for exceptional water usage, the City Engineer may require that the Owner(s) enter into an
