BACKGROUND As a matter of procedure, the City Council is routinely asked to ratify the actions taken by the Intergovernmental Relations (IGR) Committee. This is done by submitting the minutes of each committee meeting to the council. RELATED CITY POLICIES Ratification of IGR Committee actions is the making or affirming of the City of Eugene’s policy with respect to Federal and State legislative issues or such other matters as may come to the council from the committee. COUNCIL OPTIONS The council may ratify or decline to ratify the IGR Committee’s actions as set forth in the minutes of the committee's meeting. CITY MANAGER’S RECOMMENDATION The City Manager recommends ratification of the IGR Committee's actions as set forth in the minutes of the committee's meeting. SUGGESTED MOTION Move to ratify the IGR Committee's actions as set forth in the minutes of the June 1, 2011 IGR meeting. ATTACHMENTS A. Call to Order and Review Agenda Mr. Poling called the meeting of the Council Committee on Intergovernmental Relations (CCIGR) to order. Mr. Clark and Mr. Walsh joined the meeting via speakerphone. There were no changes to the agenda. 3. Review Pending Legislation The committee reviewed Senate Bill 0376A, which was pulled by Ms. Taylor for further discussion. Ms. Taylor moved to change the City’s position on Senate Bill 0376A to Neutral. The motion died for lack of a second. Mr. Walsh reported that the bill had passed out of committee, had passed the Senate by a vote of 25:0, and it would probably be passed by the Oregon House of Representatives before the council had a chance to consider the committee’s recommendation. Mr. Clark assumed that the lack of a second meant that the staff recommendation would be retained. Mr. Poling anticipated that Intergovernmental Relations staff would not lobby for the staff position until the full council considered the committee’s action. The committee briefly discussed its process for reviewing bills and the practical effect of a motion that died for lack of a second. Committee members did not agree about the effect; Mr. Clark recalled that the committee agreed the staff recommendation would stand when a motion to change a staff position did not receive a second, and Mayor Piercy recalled that such bills were referred to the council because there was no committee consensus regarding them. Mr. Poling briefly recessed the meeting while Ms. Mumme researched the committee’s past agreements. Mr. Clark arrived at the meeting. Mr. Poling reconvened the meeting. Ms. Wilson joined the meeting via speakerphone and reviewed the process agreed to by the committee, which also represented past practice. She indicated the staff position on legislation was not affected by motions that did not receive a second but any councilor could pull the bill in question from the Consent Calendar when the City Council contemplated adoption of the committee’s actions. She said she did not advocate for bills when the committee took a 2:1 vote. Mayor Piercy recalled that if one committee member did not agree with a staff position the bill was referred MINUTES—Eugene City Council Committee on June 1, 2011 Page 1 Intergovernmental Relations to the full council. Ms. Taylor determined from Ms. Wilson that the bill was referred to staff for a position because the City would be required to enforce it if passed. Ms. Wilson pointed out that the final vote on staff recommendations would probably not be unanimous since there was only one bill in the report and she expected Councilor Taylor to vote “no” on that motion given her position on the bill. Since the fate of the bill in question would be decided by the time the council reviewed the committee’s actions on June 13, she asked that she not be required to take the bill to the full council. There was no objection. Mr. Clark, seconded by Mr. Poling, moved to adopt the staff recommendation for priorities and recommendations for all bills that were not pulled for discussion for this meeting and the committee action for all bills that were discussed and acted upon at this meeting. The motion passed, 2:1; Ms. Taylor voting no. 3. Items from Members and Staff Members agreed that the issue of the impact of a motion that failed to receive a second required further discussion at a council process session. Responding to a question from Mr. Clark, Ms. Wilson indicated that an amendment proposed by Representative Chris Edwards related to annexation in the River Road area was likely to be attached to other legislation.
