AMENDMENT OF THE INDUSTRIAL PRETREATMENT PROGRAM
FEES AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-02-11-Fe
The City Manager of the City of Eugene finds as follows:
A. Sections 2.020 and 6.546 of the Eugene Code, 1971, authorize the City Manager
of the City of Eugene to determine and set fees and charges to be impesed by the City for
services, goods, use of municipal property, and licenses and permits, and specifically charges
and fees to be paid by the industrial users of the City wastewater system who are subject to the
provisions of Sections 6.501 to 6.596 of the Eugene Code; 1971.
B. In accordance with the procedures set forth above, Administrative Order No. 58-
02-1 I-F was issued on April 19, 2002, establishing the Industrial Pretreatment Program Fee
Schedule. On June 7, 2011, I issued Administrative Order No. 58 -11 -04 proposing to amend the
annual discharge permit fee contained in the Industrial Pretreatment Program Fee Schedule. The
current fee and proposed fee were set forth in the Notice of Intended .Amendment attached to
Administrative order No. 58- 11--04 as Exhibit A.
C. Notice was provided to the Mayor and City Councilors, made available to persons
who had requested such notice, and was made available - for inspection by interested persons at
the City Manager's office, 777 Pearl Street, Room 105, Eugene, Oregon, 97401, during normal
business hours. The Notice was also posted at two locations at City Hall and published in the
Register -guard Newspaper on June 17,, 2011. The Notice provided that written comments would
be received for a period of 15 days from the date of publication and posting. No comments were
received within the time or in the manner provided in the Notice.
- D. I find that the Industrial Pretreatment Program -Fee Schedule should, be amended
as proposed. In determining the fees, I have considered the, applicable policies, enactments and
directives of the City Council, the amount charged for these services by the City in the past, the
full costs of providing these services supported by the fees, the amounts charged by other
comparable providers,' and the revenue needs of the City as determined by the adopted City
budget. In. addition, Section 6.546 of the Eugene Code, 1971, requires that fees be established to
reduce the City's cost of providing set u and operation of the pretreatment program; sampling, y p g p .
monitoring, inspections and surveillance procedures; review of accidental discharge procedures
and control; and review of and acting upon permit applications.
On the basis of these findings, I order that:

2. The unarnended fees established by Administrative Order No. 5 8 -02- -1 *1 -F remain
in full force and effect and are incorporated into the fee schedule attached as Exhibit A to this
Order.
30 Administrative Order No. 58-02-11-F is repealed as of the effective date of this
Order.

INDUSTRIAL PRETREATMENT PROGRAM FEE SCHEDULE
Fee
Annual discharge permit:
Annual discharge permit fee is a nonrefundable fee as established by
Oregon Administrative Rule 340 - 045 -0075: Permit Fee Schedule Table
70E (Annual Pretreatment Fees — Significant Industrial User) and shall
be paid to the City by each permitted Significant Industrial User (SIU).
The fee shall be due annually on August 1 and will be applied to each
SIU specified in the City's annual DEQ Pretreatment Report for the
previous calendar year.
Mobile waste hauler initial application and permit .............. ............................... $250.00

Fee for recovering the City's costs involved in monitoring and resampling permittees who have
exceeded a permit limit shall be computed on the basis of the hourly wage then in effect for the
personnel performing the service, plus 10% for administrative overhead, together with laboratory
costs and expenses.
Application fees are non - refundable.
The above fees do not apply to City owned or operated vehicles.
