GRANTING AUTHORITY TO THE CITY ENGINEER, TO EXECUTE
AMENDMENTS TO LOCAL SPONSORS COST SHARING AGREEMENT
FOR THE EUGENE-SPRINGFIELD METROPOLITAN WATERWAYS
FEASIBILITY STUDY.
The City Manager of the City of Eugene finds that:
A. Under Section 16(2) of the Eugene Charter of 2002~ the City Manager is given
attthority to propose the budget, make all purchases and act as a business agent for the City Council
in connection with the sale of real estate and other business and commercial transactions.
B. Pursuant to that authority I have executed on behalf of the City of Eugene an
Agreement (the "Agreement," City of Eugene Contract No. 2004-00217) between the Department
of the Army, the City of Eugene, the City of Springfield, and Lane County for the Eugene-
Springfield, Oregon Metropolitan Waterways General Investigation Feasibility Study (the "Study")
with an effective date of September 30, 2003.
C. An agreement concermng the manner in which the obligations and responsibihties
of the local sponsors of the Agreement (Lane County and the cities of Eugene and Springfield) will
be assigned is set forth in an Intergovernmental Agreement (City of Eugene Contract No. 2004-
00218) (the "IGA") which I have executed on behalf of the City of Eugene.
D. The IGA provides the parties will annually enter into written budget agreements/'or
the Study, assigning the individual responsibilities of each party to furnish services or funding fbr
the local govermr~ent sponsors of the Agreement during the ensuing federal fiscal year, for each year
that the Agreement remains in effect, and that any mid-year amendments that affect project costs will
be made under written change orders. The City's obligations under the Agreement are being
performed by its Public Works Department, and it would be more efficient to authorize the City
Engineer to execute the annual Budget Amendments to the IGA on behalf of the City of Eugene.
Now, Therefore,
The City Manager of the City of Eugene orders and directs that:
1. Based on the above findings, which are hereby adopted, the City Engineer, is
authorized to execute on behalf of the City of Eugene annual budget amendments to the

Intergovernmental Agreement between Lane County and the cities of Eugene and Springfield,
provided that such amendments are limited to the budget amount subsequently approved and adopted
by the City Council. In addition to the in-kind services and cash contribution specifically approved
by the Council's adopted budget, the annual budget amendments will also reflect other projects and
activities which are, or are expected to be, budgeted for activities which although not specifically
associated with the Study, qualify as "match eligible." Examples of these ~'match eligible" activities
include, but are not limited to, Planning & Development Department staff time working on the
Natural Resource Study analysis of inventoried sites, and Parks & Open Space staff time
documenting stream stability problems.
2. Subject to the limits of the City's adopted budget for the A~eement activities, the
City Engineer, is further authorized to execute on behalf of the City of Eugene any change orders
necessary to carry out the Agreement in accordance with the IGA and its ammal budget amendments.
