SECTION Is TITLE

A. This Ordinance shall be known as the "Comprehensive Zoning
Plan of the City -of Eugene"'.
B. This Ordinance shall consist of the text hereof and the map

entitled "Eugene Oregon Zoning Reap 3 Part of the Comprehensive Zoning
•
Plan" , and identified by the approving signatures of the Idayor, the
President • of the Planning Commission and the City Recorder of this

City. • If any conflict between said map and this ordinance should
arise the text _ of this Ordinance will prevail.

SECTION II, PURPOSE
A. The purpose of this ordinance is to establish for the City r
of Eugene, a comprehensive zoning plan designed to regulate and -

restrict the location and use of buildings, structures, and land -
:::
for residence commerce , industry, and other purposes to regulate _
... ;, �.
and limit the height number of•stories, and percent of lot coverage -
-
of buildings and other structures hereafter erected or altered; to
establish minimum widths and areas for the subdivision or resubdi-

vision of lots; and to regulate and establish minimum requirements =

for private garages or off — street parking facilities according to '
zones or districts and type of building or structure.
B. The controls as set f orth in this Ordinance are deemed
-
necessary in order to encourage the most appropriate use of land; to - -
conserve and stabilize the value of property; to aid in the rendering -
of fire and police protection; to provide adequate open spaces for :

light and air; to lessen the congestion of automotive traffic and j ..
parking on streets; to give an orderly growth to the City, preventing

undue concentrations of population, and thereby aiding in the planning -

of community utilities and facilities such as gate, sewerage, electric
cal distribution systems; 'transportation ; school - s, . 'and other

_ public requirements ; and to promote public health, s of ety, and. general
welfare.
SECTION III. DEFINITIONS -
A. For the purpose of this Ordinance certain words, terms, and
,phrases are def fined as follows
Re - Words used in present tense include the f uture : the singu-
lar member includes the plural; and the word "shall" is mandatory and
not directory. whenever the term "this Ordinance" is used herewith, it
shall be deemed to include all amendments thereto as may hereafter ,from
time to time be adopted.
ACCESSORY BUILDING shall mean' any subordinate building. or
portion of a main building, . the use of which is incidental,
appropriate, and subordinate to that of the main building.
ACCESSORY USE shall mean a use incidental' appropriate,
and subordinate to the main use of a lot or building. �=
~ ALLEY: A public gray not over thirty (3O) feet wide providing
r a secondary means .of access to private property,
e . ALTER: To change any of the supporting members of a - building
- _ or structure, such as bearing galls, columns beams 9 or girders u
APARTMENT HOUSE: A building or portion thereof used or intended
to be used as the home of three (3) or more families' or house-
holders living independently'of each other,

AUTO COURT A combination or group of two (2) or more detached
or-semi-detached permanent dwellings or dwelling units occupying
a building site in one ownership ovined . and used to furnish tran-
sient living accommodations= ,
_ AUT0I!0PILE TRAILER CAITP. A parcel of land used for the accommo-
r dation of two 2 or more automobile trailers occupied as living
or sleeping quarters
AUTOMOBILE and/or TRAILER SALES AREA: Uncovered premises - used
for display, sale, or rental of new or used automobiles or

trailers.
AUTO AUTO WRECKING YARDS (JUNK YARDS) : Premises used for the storage
.. or sale of used automobile parts or for the storage, dismantling,
or abandoni:ient Uf junk, , obsolete automobiles , trailers, machinery,
or parts thereof
. , BASEtEDJT ; A story partly or wholly under ground'. A basement,
shall be counted as a story for purposes of height measurement

BUILDING The , terms "building" and "structure" shall be synony. ,
mous and shall , mean that which is framed, erected, constructed, -

or placed to stand temporarily or perma nently on 'a parcel of
land. Driveways or walks not more than six (6)'inches higher`' -

BUILDING HEIGHT The vertical distance from the average .

exclusively for occupancy by two (2). families living independently
of each other. _

guests or by servants employed on the premises.

STREET: A public thoroughfare, avenue, road, highway, boulevard,
parkway, way, drive, lane, court, or private easement providing
the primary roadway for ingress and egress from the property
abutting thereon.

SECTION lV : DISTRICTS OR ZONES
In order to carry out the purpose and provisions - of this ordinance,
every part of the City of Eugene, exclusive of streets, alleys; and public
lands used or reserved for governmental purposes, is hereby classified in
one of -the following districts. In case any of the said streets or alleys
have been or-are hereafter vacated, the land shall take the district or
zone classification of the property to which it reverts. Public land ac--
quired prior to the adoption of this ordinance shall be limited to the use
. for which the land was acquired and/or any use established for the highest
abutting district. Development of public land acquired subsequent to the
passage of this Ordinance shall conform to the district ip' Which it is 10--`
• ' cated. In the event public -• land is sold for private development, it •shall ;

A . USE .. .
No building, structure, or land shall be used, and no building or
structure shall be hereafter erected, structurally altered, enlarged or
maintained except for the following uses
1. A'dwelling intended.-and designated exclusively for one
(1)..family, _

2. Dvvellings for two (2) families (duplex) on .corner lots provided
.that the minimum lot area per family unit shall be twenty -five hundred
_, (2500) square feet and' the maximum lot coverage shall not exceed forty (} .

• as garage, store . rooms, wood sheds, work -shops , laundries, playhouses,

rabbits, bees, and the like, and the keeping of domestic except
pigs, as an incidental use, provided that:
a. Cows, horses, sheep, or goats cannot be kept on lots
having an area of less than ten thousand (10,000) square feet,'
and under no circumstances shall they be kept for commercial

the dwelling is not changed.

B. PARKING SPACE REQUIRED -
:There 'shall be '.at least one permanently reserved parking space
or a private garage on the. same lot, or attached to or made a part
of the main building. Such parking space shall be not less than
eight - (8 ) feet pride and eighteen (18 feet long. The parking . space.
or garage shall be provided at the time of the erection of the main
building , and . it shall have adequate provisions for ingress and
egress 'by standard size automobiles.

C . -SIGNS :
Signs and name plates may be installed as follows:
19 One (1) name plate not exceeding one and one --half (1
square feet in-area for each dwelling unit, indicating the name of
the occupant, or the occupation in the case of A.: s13. ,b. (above).

for buildings other than dwellings.

;No building or structure nor the enlargement of any building
or structure shall be hereafter erected to exceed two and one -half

(2 or more than thirty --five (35 ) feet in height , except
hospitals public schools , or churches which may be increased in
height to three (3) stories or forty - --five (45) feet. single - family
dwellings -may be increased to three (3 ) stories or forty --five (45)
feet; provided the side yards are increased to . twenty (2G) percent
of the . lot - width but not necessarily greater than twenty (20) feet .
In no case , however, ' s hall the side yard for three (3) story dwell -
ings .be less than twelve (12)-feet.
E. AREA =
1. Size of lot. Residential lots shall have a minimum average
width of sixty G feet, and the minimum lot area per dwelling
shall be six thousand (6, 000) square feet, except that where a lot
has an average width of less than sixty ( feet and an area of less
than six thousand (6,000) square feet at the time this Ordinance
became effective, such lot ray be occupied by any use permitted in
this section.

2 . Percent of coverage . The main building and accessory buildings
, located on any building site or lot shall not cover in excess of thirty
(3C) percent of the lot . area. .
F BUILDING SETBACK REQUIRMNTS
' '.. 1. Front Yard. Front yards shall not be less than fifteen (
# feet deep nor less than the �

and Section XXV. A garage attached to or made a pant of the main

. , building with the entrance on the front of the property shall have a
set -back from the front property line of not less than twenty' (2D) feet.
2. Side yard. On interior lots and the interior side of corner ti
' lots there shall be a side yard on ' each side of the main building of -
not less than three (3 ) feet. Accessory buildings located less than .

` side yard requirements. On corner building sites no main building

SECTION X VIII. • ADMINISTRATION AND ENFORCEMENT
A . BUILDING INSPECTOR
1. It shall be the duty of-the Building Inspector to see
that this Ordinance is enforced through the proper legal channels.
He shall issue no permit for the construction or alteration of
1 any building or part thereof unless the plans, specifications, ...
- - and intended use of such building conform in all respects to 'the • .

2 . The Building Inspector shall have the authority to enter +

the enforcement of the provisions of this Ordinance.
SECTION XIII e VALIDITY
If any section, subsection, sentence, clause, or phrase of this,

Ordinance is for any reason held to be unconstitutional, such holding
shall not affect the validity of the remaining portions of the ordinance.
The Common Council of the City of Eugene hereby declares that it would
`
have passed this Ordinance and each section subsection, sentence, clause,
or phrase, irrespective of any portion declared unconst•ituti•onal.
SECTION M . CONFLICTING PROVISIONS
All ordinances or parts ' of ordinances ' in "conflict herewith are hereby
repealed.
SECTION MI a NIOLATION AND PENALTIES

A person, firm, or corporation - violating any of the provisions of
this ordinance shall upon conviction thereof be punished by a fine of not

more than two hundred dollars ($200) and in default 'of payment thereof,
by imprisonment for one day for each two dollars ($2. .00) of such unpaid
fine. Each such person, firm, or corporation shall be deemed guilty of
a separate offense for each and every day during any portion of ivhich any
violation of any provision of this ordinance is Committed or continued by
such -person, firm, or corporation" and shall be ' punished accordingly d
SECTION III. 'EFFECTIVE DATE
This ordinance shall take effect and be in force thirty (30) days
