ADOPTED: December 20, 2011 SIGNED: December 20, 2011 PASSED: 7:0 REJECTED: OPPOSED: ABSENT: EFFECTIVE: December 20, 2011 Sunset Date: April 15, 2012 ORDINANCE NO. 20484 AN ORDINANCE TEMPORARILY ALLOWING CAMPING IN TENTS INHERE CAMPING IN VEHICLES IS NOW ALLOWED UNDER SECTION 4.816 OF THE EUGENE CODE, 1971; PROVIDING FOR AN IMMEDIATE EFFECTIVE DA'rE; AND PROVIDING A SUNSET DATE. The City Council of the City of Eugene finds as follows: A. Section 4.816 of the Eugene Code, 1971 (EC) provides for the regulation of overnight sleeping. EC 4.816(1)(a) and (c) contain provisions for overnight sleeping in a vehicle, camper or trailer under certain circumstances and in certain areas. B. In order to facilitate the transition for Occupy Eugene members, a temporary exception to the provisions contained in EC 4.816(1)(a) and (c) concerning overnight sleeping should be granted to allow for overnight sleeping in a tent where overnight sleeping would be allowed in a vehicle. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1 . The findings set forth above are adopted. Section 2. EC 4.816(1)(a) and (c) are amended to provide that, for purposes of the overnight camping provisions of EC 4.816(1), a tent shall be considered a "vehicle." Section 3. Due to the immediate termination of the overnight camping exemption at Washington- Jefferson Park, an emergency is declared to exist that cannot be addressed by the ordinance adoption procedures of Section 28(1) of the Eugene Charter of 2002. Immediately prior to adoption of this Ordinance, the City Council unanimously agreed to proceed with consideration of this Ordinance with an abbreviated notice of the public hearing date. Section 4. As this matter has been declared an emergency, pursuant to the provisions of Section 32(2) of the Eugene Charter of 2002, with the affirmative vote of two- thirds of the members of the City Council, upon adoption by the Council and approval by the Mayor, or passage over the Mayor's veto, this Ordinance shall become effective immediately. Section 6. Unless extended or made permanent by future Council action, this Ordinance shall sunset and be repealed on April 15, 2012. Passed by the City Council this 20 day of December, 2011.
