HomeMy WebLinkAboutAdmin Order 52-12-01ADMINISTRATIVE ORDER NO. 52 -12 -01 of Fire & Emergency Medical Services City of Eugene, Oregon DELEGATING TO THE EMS BILLING MANAGER THE AUTHORITY TO COMPROMISE AMBULANCE SERVICE CLAIMS. The Executive Director of Fire & Emergency Medical Services finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the City Manager is designated as the administrative head of the City, and is specifically authorized to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce all ordinances of the City. B. Section 2.582 of the Eugene Code, 1971, authorizes the City Manager or designee to modify, compromise or cancel a debt owed to the City, provided that the City Attorney has first reviewed the proposed modification, compromise or cancellation. C. On March 26, 2012, the City Manager issued Administrative Order No. 21 -12 -05 delegating to me, as the Fire Chief of the City of Eugene, the authority to cancel ambulance service claims due the City of Eugene upon determining that there is no likelihood that the City will recover any of the claim owed. Administrative Order No. 21 -12 -05 also authorized me to sub - delegate that authority. D. I find it would be more efficient and in the public interest to sub - delegate to the EMS Billing Manager the authority granted to me by Administrative Order No. 21- 12 -05. NOW, THEREFORE, The Executive Director of Fire & Emergency Services orders and directs that: 1. As authorized by Section 2.582(4)(e) of the Eugene Code, 1971, the EMS Billing Manager is authorized to cancel ambulance service claims due the City of Eugene upon determining that there is no likelihood that the City will recover any of the claim owed. 2. Pursuant to Section 2.582(6) of the Eugene Code, 1971, the proposed cancellation of claim shall be reviewed by the City Attorney before the EMS Billing Manager actually cancels the claim.
