ISSUE STATEMENT
As a representative of the property owners, Terri Harding, Satre Associates, requests the City Council
initiate an amendment to Chapter 9 of the Eugene Code to establish a Special Area Zone for an historic
city landmark property, the Johansen-Moody house located at 370 River Road. If initiated by the City
Council, the proposed code amendment would be the subject of public hearings before the Planning
Commission and City Council prior to final action. City Council initiation of the code amendment
process does not indicate support for the amendments.
BACKGROUND
There is no Council action history related to this specific request.
On May 27, 2004, the property owners, Kathleen Hall and Peter Drongesen, obtained city landmark
designation from the Historic Review Board for their house located at 370 River Road. The property is
currently zoned R-1 Low Density Residential and the property owners seek to change the zoning with
the creation of a Special Area Zone for the property that would enable on-going preservation of the
building and property, along with uses such as an antique store and tea house. The property owners
have submitted a concurrent zone change application to implement the Special Area Zone once it is
established in the Eugene Code through this code amendment process.
The house was built in 1901 in a vernacular-gothic architectural style. Originally, the house was sited
on a farm that was divided into smaller lots many years ago. The house is associated with the Danish
settlement of the River Road and Danebo areas of Eugene. The house fronts the west side of River
Road, just south of Briarcliff Avenue and north of Holeman Avenue.
RELATED CITY POLICIES
The purpose for creating Special Area Zones, Section 9.3000 of the Eugene Code (EC), states in part:
"Application of S Special zone to a lot containing a specific building, structure, object, site or
archeological resource that qualifies as an historic landmark will ensure that permitted uses encourage
preservation of historic qualities."

EC 9.3015 Process for Establishment or Change of an S Special Area Zone states:
Establishment of an S Special Area zone shall be processed as a Type V application as provided for in
EC 9.7500 through EC 9.7560 Type V Application Procedures, based on the criteria in EC 9.3020 and
the required provisions of EC 9.3030. Application of the S Special Area zone to specific areas shall be
processed concurrently with establishment of the special area zone. Future application of the zone to
specific properties shall be processed as a zone change.
EC 9.7505 Type V Application Requirements and Criteria requires that land use code amendments be
reviewed under the Type V application review process. EC 9.7510 City-Initiation of Applications states
that the City Council may initiate a Type V application on its own behalf, or in response to a person's
written request filed with the Planning Director that the city council initiate a land use code amendment.
CO[INCIL OPTIONS
The council has the option to:
1. Initiate the code amendment process; or,
2. Decline to initiate the code amendment process.
CITY MANAGER'S RECOMMENDATION
The City Manager recommends that the council initiate the requested code amendment. The council
would then have the opportunity through the application process to consider establishing a Special Area
zone and consider its merits as applied to the site.

Move to initiate a code amendment to Chapter 9 of the Eugene Code to consider the establishment of a
Special Area Zone for the Johansen-Moody house site at 370 River Road.

ASSOCIATES Re: Initiation of Type V Code Amendment - Johansen-Moody House
Dear Steve:
I would like to request that the City Council initiate a Type V apPlication to create a
Special Area Zone for the Johansen-Moody House at 370 River Road owned by
Kathleen Hall and Peter Drongesen. The property was designated as a City of Eugene
Historic Landmark by Eugene's Historic Review Board on May 27, 2004 (HD 04-01).
The house was constructed in 1901 in the Gothic Vernacular style, and is currently
used as an antique store.
The Land Use Code allows creation of Special Area Zones (SAZ's) to protect historic
structures, stating "Application of the S Special zone to a lot containing a specific
building, structure, object, site; or archeological resource that qualifies as an historic
landmark will ensure that permitted uses encourage preservation of historic qualities"
(9.3000, page 9-121).
The creation and application of the SAZ is processed as a code amendment and zone
change per the procedures starting at EC 9.3000. I have drafted Special Area Zone
language that allows a specific range of uses appropriate for the site based on
conversations with city staff. The PrOposed use list includes residential, office, and
small scale retail uses such as an antique store and specialty retail. The owners intend
to use the property for an antique store and tea room. Public hearings on the proposed
language will be held by both the Planning Commission and City Council. I
anticipate submitting the land use application in the next week or so.
