Councilors Present: Mayor Piercy, George Brown, Betty Taylor, Alan Zelenka, George Poling, Mike Clark,
Pat Farr, Chris Pryor, Andrea Ortiz
Mayor Piercy convened the October 22, 2012, City Council meeting.
1. PUBLIC FORUM
• Regna Meritt, Portland, supported Resolution 5065, opposing transport of coal.
• Deb Frisch suggested the Register -Guard is a bad influence in our community.
• Lynn Anderson opposed coal transport citing declining property values and huge costs to taxpayers.
• Debra McGee opposed coal transport, citing health issues.
• Sally Crum opposed coal transport, citing health issues.
• Jim Olmsted opposed coal transport through Eugene.
• Mel Bankoff opposed coal trains, citing health and protecting the earth for youth.
• Laura Ohanian opposed coal transport citing environmental concerns.
• Paul Cosgrove, Portland, opposed some of the language of the bag ban; supported eliminating fee.
• B Rivers, opposed coal transport and wanted jobs discussions to happen - visioning session for jobs.
• Leroy Marney supported coal transport citing jobs needs.
• Jere Rosemeyer opposed coal transport, citing hazards, derailments, and risk.
• Brock Nelson, Union Pacific, supported transport of coal by train.
• Carla Hervert opposed coal transport through Eugene.
• Juan Carlos Valle opposed Deerbrook Development and coal transport; supported acquisition of
Amazon Headwater Lands.
• Benton Elliott opposed coal transport citing health and environmental concerns.
• Donald Burton opposed coal transport through Eugene.
• Sabra Marcroft, Ward 7, supported bag ban, citing environmental concerns.
• Greg Peden, Portland, NW Alliance of Exports, supported coal transport for job creation.
• Gordon Levitt, UO law student, opposed coal transport, citing health concerns.
• Kyle DeBord opposed transport of coal, noting extraction and export of 'pollution' is not good.
• Annski Williams Simrat opposed coal mining, use and transport, citing environmental concerns.
• Joe Tyndall opposed coal transport.
• Sarah Higginbotham, Environment Oregon, supported the plastic bag ban.
• Charlie Plybon supported the plastic bag ban, citing problems with plastic for future generations.
• Sage Fox, age 14, opposed coal transport, citing health and environmental concerns.
• Cameron Fox opposed coal transport, citing environmental concerns, safety issues and high risk.

2. CONSENT CALENDAR
MOTION AND VOTE:
Councilor Brown, seconded by Councilor Farr moved to approve the Consent Calendar.
PASSED 8:0.
3. ACTION: West Eugene Enterprise Zone Boundary Amendment
MOTION AND VOTE:
Councilor Brown, seconded by Councilor Farr, moved to adopt Resolution 5072, authorizing
application to the State of Oregon for a West Eugene Enterprise Zone boundary amendment.
PASSED 7:1, Councilor Taylor opposed.
4. ACTION: An Ordinance Encouraging the Use of Reusable Bags, Banning Single -Use Plastic
Carryout Bags, and Adding Sections 6.850, 6.855, 6.860, and 6.865 to the Eugene Code, 1971..
MOTION:
Councilor Brown, seconded by Councilor Farr, moved to adopt Council Bill 5078, an ordinance
concerning a ban on plastic bag use.
MOTION TO AMEND:
Councilor Farr, seconded by Councilor Clark, moved to amend to change the word "shall" in
section 6.860 to "may" and to eliminate subsection B. FAILED 4:5; councilors Brown, Ortiz,
Taylor and Zelenka opposed. Mayor Piercy broke tie in opposition.
MOTION TO AMEND:
Councilor Pryor, seconded by Councilor Zelenka, moved to strike the words "Post Consumer"
from the definition of the recycling content of the paper bags. PASSED 8:0.
VOTE ON MAIN MOTION AS AMENDED:
PASSED 6:2, councilors Poling and Clark opposed.
5. ACTION: Transport of Coal for Export through Eugene:
MOTION: Councilor Brown, seconded by Councilor Taylor moved to adopt Resolution 5065
opposing the transport of coal for export through Eugene.
MOTION TO AMEND AND VOTE:
Councilor Zelenka, seconded by Councilor Brown, moved to amend Section 5 to include a
review of a comprehensive independent health impact statement. PASSED 8:0.
VOTE ON MAIN MOTION AS AMENDED:
PASSED 5:3, councilors Farr, Poling and Clark opposed.
