BACKGROUND On November 6, 2012, Ward 6 City Councilor Pat Farr was elected to serve on the Lane County Board of Commissioners for a term beginning in January 2013. On December 21, 2012, Councilor Farr submitted his letter of resignation from the Eugene City Council, effective 11:59 p.m. on December 31, 2012. Applications from Ward 6 residents interested in filling the anticipated vacancy were solicited from October 10 to November 9, 2012. The two candidates who applied were interviewed by the Mayor and City Council on December 4. The Eugene Charter outlines the process for filling a vacancy on the City Council: Section 24. Vacancies - Filling. (1) The Eugene Water & Electric Board shall fill a vacancy on the board by appointment within ninety days after the vacancy occurs. (2) The council shall fill a vacancy in any other elective city office by appointment within ninety days after the vacancy occurs. A person so appointed shall hold office until the successor to the office is duly elected and qualifies therefor. (3) If the position of a city councilor or mayor becomes vacant more than 100 calendar days prior to the May election of any year, an election to fill that vacancy shall be conducted in the same year. If the position of city councilor or mayor becomes vacant less than 100 days prior to the May election of any year, the election to fill that vacancy shall be conducted the next year. If a candidate for election to a vacated position achieves a majority of all votes cast for that position in the May election, that candidate shall assume office the following July 1, notwithstanding Section 21 of this charter. The term of office of any person elected to fill a vacancy shall expire when the term of the vacated position expires. S:\CMO\2013 Council Agendas\M130107\S130107A.doc A special election will be held on May 21, 2013, for a Ward 6 representative to complete the remainder of Farr’s term. The person who receives more than 50 percent of the vote at this special election will be sworn in on July 1, 2013, and serve until January 2015. COUNCIL OPTIONS The City Council may appoint one of the two candidates or choose another course of action. CITY MANAGER’S RECOMMENDATION The City Manager has no recommendation on this item. SUGGESTED MOTION Move to appoint _________________________________ to replace Pat Farr.
