CITY COUNCIL PUBLIC HEARING 1. PUBLIC HEARING: An Ordinance Concerning Charges for Stormwater and Parks Service and Amending Sections 6.411, 6.416, 6.421, 6.426, 6.431, 6.436, 6.600, AND 6.605 of the Eugene Code, 1971 Ruth Duemler - Opposed; wrong time to increase fees/tax; it's too much for poor people to pay.  Bob Siegmund - Opposed; feels the City’s spending priorities are questionable.  Jeff Lozar - Opposed; he would be subject to new tax twice as a business and homeowner.  Kathleen Gaffney – Opposed; noted concerns about seniors living on fixed incomes/lost homes.  Brian Weaver - Opposed; City costs have increased, so cut employee costs.  Rev. Douglas Vaughan – Opposed; idea has a lot of people upset, poverty levels rising.  Dennis Gabrielson – Opposed; tax is regressive and money was wasted on the survey.  Greg Osborn – Opposed; the ordinance is poorly written and vague.  Scott Smith - Opposed; fee is not about stormwater, it's about filling holes in the budget.  James McCarthy – Opposed; enjoys parks system but wants volunteers to maintain parks.  Diane Thurlow – Opposed; feels City process is corrupt, City Council meetings serve no purpose.  Charles Hibberd – Opposed; fixed income households can't afford the tax.  Tony Antone – Opposed; the City has a spending problem and needs to get it under control.  Bonny Bettman-McCornack – Opposed; City has been in "financial crisis" for years; fee regressive.  Dennis Casady – Opposed; City needs to live within a budget just like citizens.  Vicki Mello – Supported fee; volunteers are vital to parks, the fee will protect parks.  Douglas Moorhead – Opposed; separate stormwater and parks fees, and clarify their purpose.  Nick Urhausen – Opposed; this tax is not deductible, put it on the ballot.  Laura Fenimore – Opposed; rule of law, deceptive proposal; can't justify spending money.  Jenn Perry – Opposed; EWEB bill is already high, as costs rise, EWEB will shut off electricity.  Bob Macherione – Opposed; City must live within its means, move to neutralize voter rights?  Mayor Piercy closed the public hearing and opened the second public hearing item. 2. PUBLIC HEARING: An Ordinance Concerning Prohibited Uses and Special Use Limitations in the /ND Nodal Development Overlay Zone in Downtown; and Amending Section 9.4280 of the Eugene Code, 1971 (City File CA 12-3) Laura Potter - Chamber of Commerce supports the overlay zone.  Dave Hauser - Supports proposed amendment. It is modest, timely and good for downtown.  Scott Sanders - Supports proposal noting it will bring 200 new employees downtown.  Gary Wildish - Supports this overlay zone - brings jobs, owner-occupied, no tax incentives.  Rex Fox – Supports the overlay zone – drive-thru lanes are critical to the project's success.  Kim Woodward – supports - great for business, jobs and services, and downtown Eugene.  Mayor Piercy closed this public hearing and opened the third public hearing item. 3. PUBLIC HEARING: An Ordinance Vacating the Portion of West 4th Alley Located between 4th and 5th Avenues and Lincoln and Charnelton Streets (VRI 12-3)  Cheryl Monson - supported the application, noting she has worked at this business for 15 yrs. Mayor Piercy closed the public hearing and opened the fourth public hearing item. 4. PUBLIC HEARING: An Ordinance Providing for Withdrawal of Annexed Properties from the River Road Park & Recreation District, and the River Road Water District No one signed up to speak. Mayor Piercy closed this public hearing and opened the fifth public hearing item. 5. PUBLIC HEARING: An Ordinance Concerning Urban Animal Keeping Standards; and Amending Sections 9.2010, 9.2682, 9.2740, 9.3115, 9.3210, 9.3310, 9.3810, 9.3910, and 9.5250 of the Eugene Code, 1971, and Section 4.996 of that Code (City File CA 12-2) Bill Bezuk - Proposal has flaws, too many to list in three minutes, will submit written concerns.  Denise Swanson - Supported the ordinance, with increased limits for small farm animals.  Genie Hardin- Keeps small goats outside of town, supported allowing up to four goats.  Judy Scher – Beekeeper; wants a maximum of four hives on any size lots, noting fewer isn’t good.  Katja Kohler-Gause –Raises goats, chickens, rooster, ducks; supportive of proposal.  Katharine Hunt –Beekeeper; supportive of increase to four hives on lots under 20K sq. ft.  Barbara Elliott – Beekeeper; supportive of four hives on smaller lots, more on larger lots.  Keegan Caughlin – Avid urban farmer; proposal is too strict, numbers don't pan out.  The meeting adjourned at 9:40 pm. A. WORK SESSION: City Hall Update City Manager Jon Ruiz, introduced the item. Mike Penwell reviewed previous work on this topic, research, staff work, project features, project budget and location. Discussion points, concerns, ideas:  Parking under building will be retained.  Council Chamber will be preserved, as will public art.  Council Chamber will be made more open structurally and more publicly accessible.  Cultural gifts should be more prominently and effectively displayed.  Conceptual design will reveal more detail about what will be preserved.  Budget concerns – 15 million + one time money, where will the one time money come from?  One time money could be used to close current budget gap.  Consider aggregate building to make money stretch further – partnerships/community  Keep building, design team, talent and overall process as local as possible  Request for detailed budget breakdown of both internal and external costs  Hope to stay within the 15 Million dollar budget – land, parking, connection to past  Remodeling is normally expensive, hidden costs and inflexible in many cases – not green  New buildings should be zero energy use, very green and efficient  Is it possible to retain the ‘duck pond’ or ‘moat’? Possibly.  Entries should be closer to the street to ‘invite’ public into the space  Questions about whether or not to keep the arc shaped mural painting behind dais seating  Some want to keep mural; others feel it is old, unattractive and doesn’t represent “Eugene.”  Be flexible about how we solve long-term budget problems while building a new City Hall.  Make City Hall accessible to all, especially youth – bring the entrances closer to the street.  City Hall should represent the character of the city.  Celebrate the past – Sister City trophies, displays, etc.  Keep voting board, update new space, heat, bathrooms, engagement space, community space  Concern expressed: Old City Hall cannot successfully and affordably be remodeled.  Several Councilors and the Mayor expressed appreciation of staff work.  Having a community meeting space would be great – for everyone  Park Blocks gathering place is important – remember that when forming ideas  Saturday and Farmer’s Market somewhere in the area? MINUTES – Eugene City Council January 23, 2013 Page 1 Work Session MOTION and VOTE: Councilor Poling, seconded by Councilor Pryor moved to direct the City Manager to pursue a City Hall design on the current site with the goal of retaining the Council Chamber, existing parking (to the extent possible) and public art as well as any other components that make sense from an operational or design standpoint. If council chooses any of the options above, staff will be requesting $750,000 to complete this phase of work. Rosemary Eason: Applauded council on stormwater fee proposal. Zachary Vishanoff: Talked about parks: certain parks are chosen as special, others are neglected. Paul Cauthorn: Said unenforced laws lead to problems; is opposed to the social host ordinance. Dennis Casady: Unhappy with elements of Social Host Ordinance; feels it is unfair to landlords. Mary Salinas: Pleaded for the safety of homeless people; noting other issues get funding. 2.CONSENT CALENDAR MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, move to approve the items on the Consent Calendar. PASSED 8:0. An Ordinance Concerning Unruly Gatherings; Adding Sections 4.670 and 4.672 to 3.ACTION: the Eugene Code, 1971; Repealing Section 4.775 of that Code; and Amending Sections 4.990 and 4.996 of that Code . MOTION: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council bill, 5081, an ordinance concerning unruly gatherings. MOTION TO AMEND: Councilor Taylor, seconded by Councilor Syrett, moved to amend the penalty section of the ordinance, lowering the fee for first time offenders and offering the option of community service. FAILED 1:7, Councilor Taylor in favor. MOTION TO AMEND: Councilor Poling, seconded by Councilor Zelenka, moved to amend the definition of section 4.670 of the original motion addressing the number of persons to constitute an ‘unruly gathering’ by deleting “10 or more persons” leaving it without a number. PASSED: 8:0. MOTION TO AMEND: Councilor Poling, seconded by Councilor Zelenka, moved to amend the definition of section 4.670, adding subsection “J” to address littering in City Code section 6.805 pertaining to persons in attendance at the gathering. PASSED 8:0. VOTE ON MAIN MOTION AS AMENDED: PASSED 8:0. A.WORK SESSION: South Willamette Street Improvement Plan Transportation Planning Engineer Chris Henry introduced project consultant Scott Mansur of DKS Associates who presented a Power Point slide show. Ellen Teninty of Cogito explained the public process underway for the South Willamette project. Issues raised by the council included: Possible use of a roundabout/roundabouts as traffic impediments for emergency o vehicles Slow down to go faster/calmer interface could encourage greater use o Added capacity on Willamette in keeping with increased urban compactness o Good traffic flow can be more important than speed o Importance of bike parking to encourage bike riding o Elimination of utility poles impeding sidewalks through the installation of o underground wiring very costly Bike routes on streets which run parallel to Willamette o B.Board, Committee and Commission Interim Replacement Motion – Clarification City Attorney Glenn Klein asked the council for clarification of a motion made by Councilor Brown on December 10 concerning the selection of interim replacements for board, committee and commission members. The council indicated by head nods that it intended the motion to mean that active applicants meant those applicants who applied during the active recruitment period only. C.WORK SESSION: Multi-Unit Property Tax Exemption (MUPTE) Program City Attorney Klein said that a motion made by Councilor Brown on Jan. 16 had been tabled to this meeting and needed to be voted upon at this meeting. The motion which had been tabled from Jan. 16 was declared by the Mayor to be on the table. The motion on the table, as originally presented by Councilor Brown on Jan. 16: I move to direct the City Manager to prepare and schedule a public hearing on an ordinance suspending the Multi-Unit Property Tax Exemption (MUPTE) program until after the City Council completes a review of the MUPTE program to determine whether changes should be made. VOTE: PASSED: 5:3, Pryor, Poling and Clark opposed.
