HomeMy WebLinkAboutCC Minutes - 01/28/2013 MeetingMINUTES Eugene City Council Harris Hall, 125 East 8th Avenue Eugene, Oregon 97401 January 28, 2013 7:30 PM COUNCILORS PRESENT: George Brown, Betty Taylor, Greg Evans, Mike Clark, Chris Pryor, Alan Zelenka, Claire Syrett, George Poling Her Honor, Mayor Piercy called the January 28, 2013, regular meeting of the Eugene City Council to order. 1. PUBLIC FORUM Joe Tyndall: Mentioned concerns about freedom, free will, addiction, drugs gang and wealth. Rosemary Eason: Applauded council on stormwater fee proposal. Zachary Vfshanoff. Talked about parks: certain parks are chosen as special, others are neglected. Paul Cauthorn: Said unenforced laws lead to problems; is opposed to the social host ordinance. Dennis Casady: Unhappy with elements of Social Host Ordinance; feels it is unfair to landlords. Mary Salinas: Pleaded for the safety of homeless people; noting other issues get funding. 2. CONSENT CALENDAR MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, move to approve the items on the Consent Calendar. PASSED 8:0. 3. ACTION: An Ordinance Concerning Unruly Gatherings; Adding Sections 4.670 and 4.672 to the Eugene Code, 1971; Repealing Section 4.775 of that Code; and Amending Sections 4.990 and 4.996 of that Code. MOTION: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council bill, 5081, an ordinance concerning unruly gatherings. MOTION TO AMEND: Councilor Taylor, seconded by Councilor Syrett, moved to amend the penalty section of the ordinance, lowering the fee for first time offenders and offering the option of community service. FAILED 1:7, Councilor Taylor in favor. MOTION TO AMEND: Councilor Poling, seconded by Councilor Zelenka, moved to amend the definition of section 4.670 of the original motion addressing the number of persons to constitute an `unruly gathering' by deleting" 10 or more persons" leaving it without a number. PASSED: 8:0. MOTION TO AMEND: Councilor Poling, seconded by Councilor Zelenka, moved to amend the definition of section 4.670, adding subsection "J" to address littering in City Code section 6.805 pertaining to persons in attendance at the gathering. PASSED 8:0. VOTE ON MAIN MOTION AS AMENDED: PASSED 8:0. MINUTES — Eugene City Council January 28, 2013 Page 1 Regular Meeting 4: ACTION: An Ordinance Providing for Withdrawal of Annexed Properties from the River Road Park & Recreation District, and the River Road Water District MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council Bill 5085, withdrawing annexed properties.
