Councilors Present:
George Brown, Betty Taylor, Alan Zelenka, George Poling, Mike Clark, Greg Evans,
Claire Syrett, Chris Pryor.
Her Honor, Mayor Piercy called the February 11, 2013, work session of the Eugene City Council to order.
Mayor Piercy changed the order of the agenda items, moving the local option levy for city services to the first
item.
A. WORK SESSION: Local Option Levy for City Services
City Manager, Jon Ruiz gave a PowerPoint presentation sharing options to address the budget gap. The
three options he addressed are:
$6 million levy
$3 million levy
Option for City fee
City budget staff will prepare two budgets: one with funding; one without. The budget without funding
would require approximately $5 million in service cuts to operate a balanced budget.
Comments, concerns and issues shared by the Mayor and council:
Some councilors favored a fee.
Some councilors supported a full levy so there can be a vote.
Support was expressed for preserving human services and public safety funding.
There is concern about consequences if the fee or levy gets voted down.
Financial information about Laurelwood Golf Course was requested.
The fee may be more stable, but also more challenging to sell to voters.
Some expressed an interest in looking at all parks, not just Laurelwood, noting that a complete
analysis would be a useful assessment tool.
The City Attorney read the elements of a proposed ordinance prepared in anticipation of this item being
placed on the ballot.
MOTION AND VOTE:
Councilor Brown, seconded by Councilor Syrett, moved to direct the
City Manager to bring back for final approval a city service fee ballot measure that could be used to
close the budget gap and fund fire and police service, homeless and basic human services, and core

quality of life services, such as libraries and swimming pools. 5:3, Councilors Poling,
Clark, and Taylor opposed
MOTION AND VOTE: Councilor Brown, seconded by Councilor Syrett, moved to direct the
City Manager to include an option for a partial exemption schedules for Eugene 4j and Bethel
School Districts. A friendly amendment clarifying that school districts would fall into the

“residential” definition of the ordinance was accepted. 7:1, Councilor Poling opposed.
MOTION AND VOTE: Councilor Zelenka, seconded by Councilor Brown, moved to change
PASSED:
Section 2.2015(3) and increase the non-residential fee to $30. 5:3, Councilors Poling,
Evans and Clark opposed.
MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to add another
category to include non-profit organizations that deal with social services and qualify for 502(c)(3).
FAILED:
2:6, Councilors Poling and Pryor in favor.

Her Honor, Mayor Piercy called the February 11, 2013, regular meeting of the Eugene City
Council to order.
1. PUBLIC FORUM:
Mary Salinas - Homeless advocate, spoke in opposition to child pornography.
Jan Aho – Said Human Services Commission is a valuable investment, shared a success story.
Leroy Marney - Concerned about Capstone project and construction standards in Enterprise Zones.
Bill Bezuk - Supported urban farming, but wants standards to be fair and reasonable.
Patrick B. Smith – Expressed concerns about Enterprise Zone construction and tax exemptions.
Barb Prentice – Interfaith Occupy and SLEEPS, asked how funds for homeless have been spent.
Cindy Clarke – AFSCME, expressed concern about proposed budget cuts and how it impacts workers.
David Ivan Piccioni - Supported farming within City limits, and animal farming for various reasons.
Bob Cassidy – supported asking the voters about budget gap.
Kirstin Lee - Looking Glass, Runaway Services, asked for increased funding for youth programs.
Rev. Wayne Martin - Pleased to see the Dalai Lama will be in Eugene.
Jerry Maul – Owner of pest control agency, concerned about rat problems, related to farm animal feed.
Erin Bonner - Veneta resident, said HSC funding for human services is a priority.
Jeff McGillivray - Concerned about tax credits for non-local and unlicensed workers at Capstone.
Kelly Sutherland - Relief Nursery, spoke about service fee and community support for human services.
Helen Liguori - Homeless advocate, expressed frustration with pace of efforts to help homeless.
Art Bollmann - Homeless advocate, frustrated at lack of action related to opportunity Eugene campsite.
Brad Foster – Supported Urban Farm Animal ordinance allowing more beehives/smaller setback.
Kimberly Gladen – Said downtown is important, but supports philanthropy, not socialism.
Susan Thomas – Supported urban farming ordinance and allowing more hives/reducing setback.
Beverlee Hughes – Food For Lane County, asked that funding be in place for social service agencies.
Rose Wilde - Asked for HSC funding support, especially for needed services like Womenspace.
Brian Weaver - Supported a levy, not a fee, noting concerns about EmX and general transportation.
2. CONSENT CALENDAR
A. Approval of City Council Minutes for January 22, 23, 28 and 30, 2013.
B. Approval of Tentative Working Agenda
C. Adoption of a Resolution Concerning the 2013 Oregon Legislature and the City Council
Committee on Intergovernmental Relations Operating Agreements Adopted By Resolution No.
5043.
MOTION AND VOTE:
Councilor Poling, seconded by Councilor Pryor, moved to approve the

3. ACTION: An Ordinance Concerning Prohibited Uses and Special Use Limitations
in the /ND Nodal Development Overlay Zone in Downtown; and Amending Section 9.4280 of the
Eugene Code, 1971. (City File CA 12-3)
MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council Bill
No. 5087, an ordinance concerning prohibited uses and special use limitations in /ND Nodal
PASSED:
Development Overlay Zone in Downtown. 6:2, Councilors Taylor and Brown opposed.
4. ACTION: An Ordinance Vacating the Portion of West 4th Alley Located Between
4th and 5th Avenues and Lincoln and Charnelton Streets (VRI 12-3)
MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council Bill

No. 5084, an ordinance vacating the portion of West 4 Alley located between 4 and 5 avenues and

Lincoln and Charnelton streets. 3:5, Councilors Poling, Clark and Pryor in favor.
5. WORK SESSION: An Ordinance Concerning Urban Animal Keeping Standards; and
Amending Sections 9.2010, 9.2682, 9.2740, 9.3115, 9.3210, 9.3310, 9.3810, 9.3910, and 9.5250 of
the Eugene Code, 1971, and Section 4.996 of that Code (City File CA 12-2)
MOTION AND VOTE: Councilor Brown, seconded by Councilor Evans, moved to increase the
PASSED:
allowable number of miniature goats from two to three. 5:3, Councilors Pryor, Taylor and
Poling opposed.
MOTION AND VOTE:
Councilor Brown, seconded by Councilor Evans, moved to increase the
allowable number of bee hives from two to three. A friendly amendment reducing the setback to 5 ft.,
provided that the hives are pointed toward the center of the owner’s property, was accepted.
PASSED:
8:0.
MOTION AND VOTE:
Councilor Brown, seconded by Councilor Syrett, moved to delete in section
"(4)(a) Animals Allowed" the phrase "any two of the following four categories of animals are allowed"
FAILED:
and replace it with City staff's original phrase "all of the following are allowed." 2:6,
Councilors Syrett and Brown in favor.
After some discussion, there was general agreement that further discussion about licensing was needed.
MOTION AND VOTE:
Councilor Clark, seconded by Councilor Pryor, moved to bring the ordinance
PASSED:
back to Council for a vote on February 20, 2013. 8:0.
Mayor Piercy requested additional language stating that the council will revisit this ordinance in two
years or sometime in the near future.

Her Honor, Mayor Piercy called the February 13, 2013, work session of the Eugene City Council to order.
A. WORK SESSION: Local Option Levy for City Services
The City Attorney reminded the council of the language changes made at the previous meeting: Bethel
and 4j School Districts would pay the residential fee, and the non-residential fee was increased from
$20 to $30.
City Attorney reviewed the three motions to be considered:
1.Motion 1 motion would adopt the resolution and allow the council to place the ordinance
before voters on the May 21, 2013 ballot.
2.Motion 2 would direct the City Manager to publish and distribute a voter’s pamphlet, including
neutral information about the fee ordinance.
3.Motion 3 would appoint up to three councilors to be on the proponent’s committee to write the
argument in favor of the measure and the rebuttal if there are arguments submitted, for the
voter’s pamphlet.
Comments, concerns, ideas and issues:
If other options can be found, cuts may be averted.
The definitions in the proposed ordinance needed refinement.
There is confusion about how separate units/businesses would pay.
Apartments and multi-unit complexes - each unit would be charged.
Businesses - one property, one address, separate entrances, all would pay.
Clarification: This fee will not expand services; it is designed to maintain current service levels.
Reminder: Services will be cut if not funded.
There are concerns about competing with other measures on the May ballot, including funding
for human services, public safety, and the number of jail beds.
Ensure the public knows what's at stake.
There are still other revenue sources to explore.
MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt
Resolution 5082 calling a city election on May 21, 2013, on a City Service Fee. PASSED: 6:2,
Councilors Taylor and Clark opposed.

MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to direct the
City Manager to publish and distribute a local voters’ pamphlet and neutral factual
information for the special election scheduled for May 21, 2013, on a City service fee, and to
authorize the expenditure of funds from the General Fund contingency account that are
required to produce that voters’ pamphlet and neutral information. PASSED: 8:0.
MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor moved to appoint
Councilors Zelenka, Brown and Pryor to the voters’ pamphlet proponent committee for the
City service fee ballot measure. PASSED: 8:0.
