ISSUE STATEMENT
The City Council is being asked to adopt a resolution authorizing Lane County to assess benefiting
properties under the jurisdiction of the City for improvements to North Game Farm Road between
Coburg Road and 965 feet southeast of Old Coburg Road. Improvements to be assessed include
concrete curb and gutter, sidewalks, and driveways.
BACKGROUND
There are several differences in the assessment policies of the County and the City that will affect the
assessment for individual properties. The section of North Game Farm Road proposed for
improvements is classified as a minor arterial. The assessable project costs under the County's
assessment policies for this road classification includes curb and gutter, sidewalks and driveways. The
same project elements are assessable under the City's assessment policies for arterials and collectors.
However, the City also assesses for a portion of the pavement width, 3-1/2 feet for minor arterials.
The County assesses for the entire frontage of the benefiting property for road improvements. The City
assesses a minimum of 50 feet for properties with less than 50 feet of frontage, the actual frontage for
properties with 50 feet to 100 feet of frontage and a maximum of 100 feet for properties with more than
100 feet of frontage. Of the properties under the jurisdiction of the City on North Game Farm Road,
there are no properties with less than 50 feet of frontage and seven properties with more than 100 feet of
frontage. A preliminary plat for a new subdivision has been filed for the large parcel on the southwest
corner of the intersection of North Game Farm Road and Crescent Avenue. The new subdivision will
have 11 properties with frontage on North Game Farm Road. For all of properties, the assessments will
be less under the County's assessment policies than for a similar project under the City's assessment
policies.
Seventeen properties under the jurisdiction of the City will be assessed for approximately 2,603 feet of
frontage. The estimated assessment based upon recent Lane County projects will be approximately
$35.00 per linear foot for concrete curb and gutter, sidewalks and driveways. The assessable frontage
for individual properties will range from 60 feet to 115 feet. Assessments may be financed through
Lane County. All nonassessable road related costs will be financed by Lane County with funds from the

County Road Fund. The City will pay approximately $25,000for the incremental cost of stormwater
improvements beyond that necessary to address stormwater within the public right-of-way.
All but one of the benefiting properties to be assessed that are under the jurisdiction of the City have
recorded irrevocable petitions. The petitions were executed at the time of development in lieu of
making improvements to North Game Farm Road with the development of the adjacent property.
Upon adoption of a resolution authorizing Lane County to assess benefiting properties under the
jurisdiction of the City for improvements to North Game Farm Road, County staff will prepare a
Director's Report to the County Board of Commissioners. A 20-day remonstrance period will begin
upon acceptance of the Director's Report by the County Board of Commissioners.
Improvements to North Game Farm Road are scheduled to be bid in February 2005 and completion of
construction is anticipated in September 2005. A public hearing on the final assessments for the project
will be held in the spring of 2006.

The City Council can take the following actions:
1. Adopt the proposed resolution.
2. Decline to adopt the proposed resolution.
CITY MANAGER'S RECOMMENDATION
The City Manager recommends adoption of Resolution 4813 authorizing Lane County to assess
benefiting properties under the jurisdiction of the City for improvements to North Game Farm Road
between Coburg Road and 965 southeast of Old Coburg Road.

RESOLUTION NO.
A RESOLUTION AUTHORIZING LANE COUNTY TO ASSESS BENEFITTING
PROPERTIES UNDER THE JURISDICTION OF THE CITY OF EUGENE FOR
IMPROVEMENTS TO NORTH GAME FARM ROAD.
The City Council of the City of Eugene finds that:
A. ORS 190.010 and the Eugene Charter of 2002 provide that units of local government
may enter into agreements for the performance of any and all functions and activities that a party
to the agreements, its officers or agents, have authority to perform.
B. ORS 373.260(1)(a) provides that counties and cities may enter into intergovernmental
agreements for the construction, improvement or repair of, and the acquisition of right-of-way for
any county road or city street within the corporate limits of the city.
C. Through adoption of the FY 04/05 Through FY 08/09 Capital Improvement Program,
the Lane County Board of Commissioners has approved the North Game Farm Road
improvement project from MP 0.413 to MP 1.69. The improvement project will improve the
existing road to urban standards and will encompass properties under the jurisdiction of City.
D. Developers/owners of certain benefiting real properties in the project area under the
jurisdiction of the City of Eugene have entered into irrevocable petitions with the City agreeing to
participate in the costs associated with bringing the adjacent County roads up to urban road
standards when upgraded in the future.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal
Corporation of the State of Oregon, as follows:
Section 1. The City of Eugene approves the improvement project described in Recital C
above.
Section 2. Lane County is authorized to assess any benefiting properties under the
jurisdiction of City for improvements to North Game Farm Road in accordance with applicable
law. The City Manager is specifically authorized to execute on behalf of the City an
intergovernmental agreement with Lane County to carry out this Resolution.
Section 3. The City Recorder is requested to forward a copy of this Resolution to Lane
County upon its adoption.
Section 4. This Resolution shall become effective immediately upon its adoption.
The foregoing resolution adopted this 11th day of October 2004.
