<br />The minutes of the adjourned meeting of the Common Council held on Monday
<br />evening, February 24, 1941 at ?:30-o-!.Q..lock p.m. Mayor Elisha Large presided over
<br />the meeting. Councilmen present were: Sam C. Bond, A. C. Farrington, Louis Koppe,
<br />E. A. Barette, Ira O. Stewart, Orren Brownson and A. L. Hawn; absent: none. A
<br />vacancy existed in the second ward because of the recent death of Councilman A. A.
<br />1, Reid.

<br />The minutes of the previous meeting were presented and ordered placed on
<br />The meeting was herewith called to order.
<br />
<br />Mayor Large called upon Mr. Harold D. Lyons to present his special, request
<br />to the council. Mr. Lyons addressed the council, stating that if, in er~cting
<br />his new building immediately South of the Methodist Church on Willamette Street,
<br />he observed the seven foot set-back according to the zone requirements, he wanted
<br />the council's assurance that it would not in the future grant any special permits
<br />for buildings on Willamette Street between his property and 13th Street which would
<br />allow the construction of a building closer than seven feet to the Street Line.
<br />IThe City Attorney informed the Mayor and Council that this council could take no
<br />laction in such a matter that would be binding upon any future council. Mr. Lyons
<br />ras informed that the qouncil would adhere to the present ordinance providing for
<br />the seven foot setback but, in the future" if in their opinion it was advisable
<br />3\ to grant a special permit, they would do so.

<br />Communication was presented by the City Recorder from the Eugene Hospital
<br />and Clinic entering a protest on the matter of constructing a jail on the grounds
<br />'Iof the City Hall. Councilman Bond reported it was the Police Committee's opinion
<br />that it was time for Lane County and the City of Eugene to construct a joint jail
<br />~ut apparently it could not be done at the present time. He felt that the hospital
<br />~as unduly alarmed concerning the council's proposal to build a new jail as compared
<br />~o the conditions of the old jail. He then outlined the details of the constructiGn
<br />and said the plans were on file in the City Engineer's office. In closing, Council-
<br />~an Bond said it would simply be a temporary jail, and no serious criminal would
<br />I~e kept there. It would be used only for one to two day purposes and very seldom
<br />~ould there be more than two, three, or four prisoners at one time. Dr. George P.
<br />Winchell of the Eugene Hospital addressed the council reviewing the contents of
<br />'~he letter and pointed out the seriousness of the condition, referring to the
<br />noise and confusion in the unloading and jailing of drunk prisoners and the effect
<br />bn p'atients who are serioUSly ill or injured patients suffering from shock.
<br />pouncilman Barette endorsed the position taken by Qouncilman Bond and pointed out
<br />~hat the old ja.il in the city hall lot had been bU1lt and in use prior to the
<br />ponstruction of the hospital. Also, the city had granted many concessions to the
<br />hospital but it was necessary for the city business to locate the jail 'on this
<br />Iproperty and it should be done. Dr. W. B. Neal of the Hospital upheld the remarks
<br />IPf Dr. Winchell and simply requested the council not to build the jail on this
<br />[ocation but if it were possible, to construct the jail adjacent to the county jail,
<br />as had once been suggested. , Councilman Brownson raised the question as to a diff-
<br />Ilerence in the handling and care of the prisoners if the jail were located adjacent
<br />~o the county jail. The answer being, that, practically speaking, there would be
<br />no difference. Councilman Bond again s,poke in b,ehalf of the present plan. Council-
<br />~an Stewart expressed the opinion that if it is possible to locate this jail
<br />Ikomewhere else, this should be done. Councilman Brownson expressed like opinion.
<br />pouncilman Brownson made a motion to reconsider the location of the jail due to
<br />~he possibility of its being built in county property immediately adjacent to the
<br />~resent county jail. The motion was seconded by Councilman Stewart. Councilmen
<br />Farrington and Bond spoke in behalf of the present plan. Councilman Hawn raised
<br />~he question as to the possibility of putting the jail in the basement of the
<br />fity Hall. It was pointed out that this would be no saving in money and it was
<br />~he opinion of the Police Committee to construct a separate building. Councilman
<br />~oppe expressed the opinion that this should be checked into a little further.
<br />ljrhe Mayor then placed the moti,on upon .roll call, councilmen voting aye: Koppe,
<br />ptewart, Brownson, and Hawn; nay: Bond, Farrington, and Barette. The motion was
<br />aeclared carried. At this time Councilman Bond made a motion to hold up any
<br />, ~inal decision of the jail until the next meet~ng of the council. The motion was.
<br />4 ~econded by Councilman Hawn and unanimously approved by the Council.

<br />II Coun'cilman Koppe, Chairman of the ,Judiciary Committee reporting on the
<br />request of the Second Hand Dealers presented at the last council meeting, stated
<br />~t was the recommendation of the committee and the City Attorney that no changes
<br />be made in t he ordinance at the present time. Motion was made and seconded
<br />~nanimously approving the recommendation. .

<br />Councilman Farrington, Chairman of the ]'inance Committee ,presented the
<br />property offers beginning with the offer of W. C. Clubb, $200, $40 down and the
<br />balance at $13.33 pr more per month plus interest at 6% for the lot on the east
<br />side of Jefferson Street beginning 40 feet north of the S.P. railroad and running
<br />\ north 85 feet and East 160 feet. The Finance Committee recommended that the offer
<br />6 be accepted and the recommendation was unanimously approved.
