<br />ADMINISTRATIVE ORDER NO. 44-96-06-F <br />of the <br />City Manager Pro Tern of the City of Eugene <br /> <br />ESTABLISHING FEES FOR SEGREGATION OF <br />ASSESSMENTS AND SYSTEMS DEVELOPMENT CHARGES <br /> <br />The City Manager Pro Tern of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br /> <br />B. In accordance with the provisions set forth therein, on June 17, 1996 I issued <br />Administrative Order No. 44-96-06 proposing to increase the currently established $25.00 fee for <br />processing applications for segregation of assessments and systems development charges to <br />$65.00, as set forth in the Notice of Intended Fees attached as Exhibit A thereto and incorporated <br />therein by reference. <br /> <br />C. Copies of the Notice were provided to the Mayor and City Council, posted at two <br />locations at City Hall on June 20, 1996, and made available for inspection by interested persons <br />at the offices of the City's Administrative Services Director, Aster Building, 860 West Park, Suite <br />300, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5 :00 p.m., Monday <br />through Friday, exclusive of holidays). The notice provided that written comments could be <br />submitted thereon for a period of 15 days from the date of posting. No comments were received <br />within the time or in the manner required by the notice. <br /> <br />D. I find that the fee increase as proposed in Administrative Order No. 44-96-06 is <br />consistent with applicable policies and directives of the City Council, including policies developed <br />through the Eugene Decisions process, is comparable to the fee established in other jurisdictions <br />for processing such applications, and is necessary in order to recover the City's costs incurred in <br />processing such applications from the beneficiaries thereof. <br /> <br />On the basis of these findings, I order that: <br /> <br />1. As of the effective date of this Order, the fee for processing applications for <br />segregation of assessments and systems development charges shall be $65.00. <br /> <br />2.
