<br />CO l-'Y <br /> <br />ADMINISTRATIVE ORDER NO. 44-9608 <br />of the <br />City Manager Pro Tern of the City of Eugene <br /> <br />REINSTATING THE CITY'S PERS POLICY AND <br />REPEALING ADMINISTRATIVE ORDER NO. 44-94-12 <br /> <br />The City Manager Pro tern finds that: <br /> <br />A. Measure 8, enacted by the voters of the State of Oregon, required that effective <br />January 1, 1995, employees of the State of Oregon and political subdivisions thereof contribute <br />six percent of their wages to any retirement plan or system of which they were members. <br /> <br />B. The City of Eugene (ttCitytt) participates in the Oregon Public Employees <br />Retirement System (ttPERStt). <br /> <br />C. On December 19, 1994, the City Manager executed Administrative Order No. 44- <br />94-12, ordering all employee contributions made to PERS pursuant to Measure 8 be made <br />through mandatory salary reduction. The mandatory reductions were to be remitted to PERS <br />by the City and treated as employer contributions under Section 414(h)(2) of the Internal <br />Revenue Code. <br /> <br />D. Measure 8 has been nullified and the City intends to reinstate the policy in effect <br />prior to the execution of Administrative Order No. 44-94-12. <br /> <br />Now, therefore, based on the above [mdings, which are hereby adopted, <br /> <br />IT IS HEREBY ORDERED THAT: <br /> <br />1. Administrative Order No. 44-94-12 is hereby repealed. <br /> <br />2. The City hereby reinstates the PERS policy in effect prior to the execution of <br />Administrative Order No. 44-94-12. <br /> <br />3. Section 3-770 of the City of Eugene Human Resource and Risk Services Policies <br />APPM, as revised October 8, 1996, indicates that the City will pay the employee contribution <br />to PERS on behalf of eligible employees.
