<br />RESOLUTION NO. L( ~($ <br /> <br />line: <br /> <br />A Resolution furthering annexation to the City of Eugene of the territory bounded by a <br /> <br />Tax Lots 3000, 3100, 3200, 3300 Assessor's Map 18-03-02-20; <br />Tax Lot 700, Assessor's Map 18-03-03-12; Tax Lot 3800 <br />Assessor's Map 18-03-02-32; Tax Lots 1100, 1200, 3800, 3900, <br />4000,4300,4400,4500,4600, Assessor's Map 18-03-03-11; Tax <br />Lots 200, 500, 700, 800, 900, Assessor's Map 18-03-03-14 located <br />in the southern Glenwood area, identified as Area B and more <br />particularly described on Exhibits B-1 and B-2 attached hereto and <br />incorporated herein by reference (Wild ish Industrial Development <br />Corp. et. al., A 96-31). <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />The annexation of the territory to the City would constitute a "minor boundary change" <br />under the boundary commission law, ORS 199.410 to 199.519. <br /> <br />By authority of ORS 199.490(1)(a) and ORS 199.505, the City Council of the City may <br />initiate the annexation with a delayed effective date. <br /> <br />The Council intends to withdraw from those Districts that part of the territory that lies <br />within the Glenwood Water District, Willamalane Park & Recreation District, by authority of <br />ORS 199.510 and 222.520 to 222.575 in the event the annexation is consummated and jurisdiction <br />of the subject portion of the Glenwood area is not transferred to Springfield through an <br />amendment to the Metropolitan Plan prior to the effective date of the annexation. <br /> <br />Pursuant to the provisions of Sections 9.150 to 9.160 of the Eugene Code, 1971, the <br />Planning Department has conducted an investigation of the application, and the Planning <br />Commission held a public hearing thereon on October 1, 1996. <br /> <br />Based upon the testimony and submittals at that hearing and the Planning Department staff <br />notes and Planning Commission minutes of September 30, October 1, and October 7, 1996 the <br />Planning Commission found the application to be consistent with the City's adopted criteria for <br />annexations and recommended approval of the annexation request. <br /> <br />No appeal of the Planning Commission's decision and recommendation of October 7, 1996 <br />has been filed in accordance with the provisions of the Eugene Code, 1971. <br /> <br />Now, therefore, having considered the Planning Commission's decision and <br />recommendation of October 7, 1996, which incorporated the Planning Department Staff Notes and <br />Planning Commission minutes of September 30, October 1, and October 7, 1996, and based <br />thereon, and upon the evidence and record submitted therewith, and the testimony before the <br /> <br />Resolution - 1 <br />
