<br />Planning Commission and Council, the City Council hereby approves the Planning Commission's <br />decision and recommendation, and, <br /> <br />IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />EUGENE, a Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. Based upon the above findings and reasons which are adopted herein, the City <br />Council hereby initiates the annexation, affirms the Planning Commission's decision and <br />recommendation of October 7, 1996, adopts the findings and conclusions in support of the <br />annexation set forth in the Planning Department Staff Notes and Planning Commission minutes <br />of September 30, October 1, and October 7, 1996, approves the annexation request, and advises <br />the Boundary Commission that: <br /> <br />1.1 In the event the annexation is consummated, the City will <br />initiate separate proceedings to withdraw the properties from the <br />Glenwood Water District and Willamalane Parks and Recreation <br />District, subject to the provisions of ORS 199.510(2)(a) unless prior <br />to that time the Metro Plan is amended to transfer jurisdiction of the <br />subject portion of the Glenwood area to Springfield. <br /> <br />1.2 Approval of this annexation is not intended to predetermine <br />the outcome of the pending Glenwood Jurisdictional Study. <br /> <br />1.3 Future transfer of this territory from the City of Eugene to <br />the City of Springfield will occur if future amendments to the Metro <br />Plan direct that such a transfer shall occur. <br /> <br />and requests that the Boundary Commission approve the annexation and to provide in its Final <br />Order that the annexation shall become effective on January 3, 2000. <br /> <br />Section 2. The City of Eugene does not object to the annexation of the within described <br />territory to the Lane County Metropolitan Wastewater Service District. <br /> <br />Section 3. The Planning Division is directed to file certified copies of the statements of <br />consent and of this Resolution with the Lane County Local Government Boundary Commission <br />in the event that owners of properties within Area B desire annexation of one or more of the <br />subject properties before the Glenwood Jurisdictional Study and any associated Metro Plan <br />amendments are completed. It is intended that this Resolution may be used to initiate multiple <br />annexations within Area B over time or be used to initiate the annexation of all of Area B as a <br />single proposal. <br /> <br />Section 4. This Resolution shall become null and void on January 3, 2000 or upon <br />adoption of a Metro Plan amendment that transfers jurisdiction for Area B to the City of <br />Springfield. <br /> <br />Resolution - 2 <br />
