<br />RESOLUTION NO. 4667 <br /> <br />A RESOLUTION ESTABLISHING HAZARDOUS <br />SUBSTANCE USER FEES FOR THE FISCAL YEAR <br />COMMENCING JULY 1, 2001. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Pursuant to Article VII of Amendment IV to the Eugene Charter of 197 6 (the <br /> <br />"Amendment"), the City Council has previously adopted Resolution No. 4587 establishing fees to <br /> <br />be paid by hazardous substance users within the City for the 1999 fiscal year, and Resolution No. <br /> <br />4634 establishing fees to be paid by hazardous substance users within the City for the 2000 fiscal <br /> <br />year. <br /> <br />B. In accordance with other requirements of the Amendment, Ordinance No. 20188 <br /> <br />adopting the 2000 Hazardous Substance Tracking Instructions was adopted by the Council and <br /> <br />approved by the Mayor on February 28, 2000, and Ordinance No. 20223 adopting the 2001 <br /> <br />Hazardous Substance Tracking Instructions was adopted by the Council and approved by the Mayor <br /> <br />on February 26, 2001. <br /> <br />C. As a result of decisions of the Court of Appeals and Circuit Court in litigation <br /> <br />involving the Amendment, the City revised the method of calculating the hazardous substance user <br /> <br />fees. Section 3.694 of the Eugene Code, 1971, which was adopted on February 28, 2000, by <br /> <br />Ordinance No. 20189, imposes a fee upon hazardous substance users in an amount per FTE to be <br /> <br />established by resolution of the Council and paid annually, no later than May 1 of each year. <br /> <br />oD. The Toxics Board has recommended a fee of $12.54 per FTE be imposed for the <br /> <br />fiscal year commencing July 1, 2001 in order to cover the expenses of the program for that fiscal <br /> <br />Resolution - 1 <br />
