<br />WHEREAS, 'by resolution duly adopted August 10, 1925, the Common Council

<br />of the City of Eugene determined to open and establish the alley between Willamet(~:

<br />and Olive Streets from 13th Avenue North 60 feet,

<br />.And Wherea s, the survey and. report of the City Eng ineer was duly made and
<br />
<br />filed by Ordinance No. 5071, passed and approved September 25th, 1925,
<br />And Whereas, the Viewers duly appointed by said Ordinance No. 5071 made
<br />and filed a report of their findings of benefits and damages to the property bene-
<br />
<br />fi tted and the property damage d by the opening of sai d alley,
<br />
<br />And Whereas, the report of said viewers was duly adopted by Ordinances No.
<br />
<br />5105, passed and approved October 16, 1925, and. 5348, passed and approved 1\lJ.ay 24,
<br />
<br />1926,
<br />
<br />And Whereas, no appeal was taken from the report of said viewers and the
<br />
<br />time for said appeal has long since expired and it appearing that said alley has
<br />'been paved in accordance with the recommendation of said viewers without cost
<br />
<br />to the owners of the property taken by said alley and according to the agreement
<br />

<br />with said owners,
<br />
<br />It is now therefore resolved that the following described property, to-wit:
<br />
<br />Beginning at a point on the North side of 13th Avenue West midway between
<br />Willamette and Olive Streets, running thence West 7 feet, thence North &0 feet,
<br />thence 14 feet East, thence South 60 feet, thence West 7 feet to the place of
<br />beginning, in the City of Eugene, Lane County, Oregon.
<br />
<br />is hereby appropriated for said alley opening, and said alley is hereby laid out,
<br />
<br />opened, and established over and upon said described tract, and the City Engineer
<br />is directed to 'prepare and delilfer to the recorder an accurate plat of said street
<br />and of t,he property so appropriated for public use, and the recorder is directed
<br />
<br />to file for record with the County Clerk of Lane County said plat and a copy of
<br />
<br />this resolution.

<br />WHEREAS, the Common Council of the City of Eugene did by resolution deter-
<br />mine to open and extend Seventeenth Avenue East from Oak Street to Willamette
<br />
<br />Street, in the City of Eugene,

<br />ance No. 1689, passed and approved February 1, 1915,

<br />And Vfuereas, the time for appeal from the report of said viewers has long
