O. Hicholls, <br />representing the Company, was present and set forth the conditions. On motion <br />duly seconded and carried their p.etition was granted by the Council. <br /> <br />A communication from Frederi,ck D. StricI~er, State Health Officer, in which <br />he stated that upon inspection o~ the city jail he found that it did not comply <br />with specifications laid down by the state laws, was ordered filed. <br /> <br />A communication from John W. Connaway concerning a refund of $6.77 on the <br />reassessment of properties abutting upon the alley between Onyx and Emerald from <br />20th to 21st, was presented and was referred to the Judiciary Committee for <br />investigation. <br /> <br />I <br /> <br />A communication from Roy C. Andrews and Dean Onthank, concerning brush piles <br />and rubbish which has been dumped on the south side of Riverwood Ave. ~n Kincaid <br />Park, was read and referred to the Chief of Police. <br /> <br />A letter from Mr. DeCou, Chairman of the Park Improvement Committee, th~nking <br />the Council for their cooperation. in the improving of the City Parks, was read <br />and ordered filed. <br /> <br />An Ordinance declaring and defining as nuisances the maintenance in open <br />years of dismembered parts of automobiles and machinery, waste material and <br />rubbish; providing a penalty and declaring an emergency was read the first time <br />and passed its second and third readings by title under suspension of the rule by <br />the unanimous consent of the Council and was placed upon its final passage. The <br />ayes and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt. <br />The Ordinance was declared passed and numbered 8424. <br /> <br />,a <br />~ ~~ <br /> <br />1 <br />II <br />II <br />I <br />II <br />II <br />I <br />~\! <br /> <br />An Ordinance to license, tax and regulate certain games and mechanical <br />devices used therein; and declaring an emergency was read the first time, and <br />Councilmen Simon and Bond opposed certain sections of this ordinance, namely, that <br />of not having an annual license for the distributor of the machine. Various <br />licenses were suggested, ranging from $15.00 to $100.00 per year." Councilman <br />Carlson opposed this very strongly, pointing out the fact that $2.00 per month <br />that this ordinance provides was all the traffic could bear, and that an increase <br />in the fee would automatically bring about a decrease in the machines operated and <br />thereby decrease the city's revenue. Councilman Simon moved that this ordinance <br />be amended as follows; An annual distributor's license fee of $10.00 for a maximum <br />of 10 machines, and $1.00 for each machine above the 10, payable in advance. The ~,,~ <br />motion was seconded and the ayes and nays were called, Councilmen voting aye 6, <br />nay Carlson, absent Zumwalt. The Ordinance then passed its second and third <br />readings by title under suspension of the rule by the unanimous consent of the <br />Council and was placed upon its final passage. Although Councilman Carlson <br />was opposed to the annual license fee feature he realized that his vote would hold <br />this subject up for anothev two weeks for passage, and he, therefore, asked for <br />reconsideration of the vote and moved that the ordinance be given its second and <br />third readings again. His motion was seoonded and carried, and the Ordinance was <br />read again the second and third time by title under suspension of the rule by the <br />unanimous consent of the Council, and was placed upon its final passage.
