M..and on Saturdays and other days when the need is apparent until <br /> 112 10:30 o'clock P. M" Action was unanimously approved. <br /> Ci ty Attorney Calkins was asked to confer '1vi th the Planning Commission the <br /> petition protesting the maintenance of an incubator factory, auto trailer building, <br /> 13 auto wrecking yard in the rear of 260 ~est 12th Avenue operated by Mr. McClanahan. <br />I ( <br /> Motion was made and Seconded that all complaints concerning the use of pro- <br /> perties coming under the zoning and building code be filed in writing to the City <br /> Recorder and automatically referred to the Police Committee with power to act. This <br /> 14 was approved by the council. <br /> I <br /> Councilman Hendershott reported that stairways were being partially blocked <br /> r 15 by use of vendors and should be investigated. <br /> The Recorder presented the matter of the ~alters-Bushong franchise for the <br /> blow pipe across High Street with a statement that the franchise fee had not been <br /> paid for the years 1936 and 1937. The City Recorder was instructed to communicate <br /> with Mr. Fred Walters and inform him that if he wished the conditions of the <br /> franchise to stand that he must pay all amounts in arrears and ~ay annually there- <br /> r16 after. Upon failure to do so, the franchise would be revoked. <br /> Resolution directing the Mayor and Recorder to execute a bargain and sale <br /> deed to Pacific Loan and Savings --Association (transaction represented by Cashman <br /> 117 and Proudfit), was upon motion made and duly seconded, adopted: <br /> RES 0 L UTI 0 N <br /> WHEREAS~ the City of Eugene is the owner of the following described <br /> property~ to-wit: <br />I "Beginning at a stone on the East line of Eugene Avenue, and said <br /> stone set in County Survey No. 644~ 54.36 chains South of the <br /> Northwest corner of the D. R. Christian Donation Land Claim, and <br /> running thence North 83 degrees 12 minutes East 490.38 feet to <br /> the middle of the County road, thence along the middle of said <br /> road South 14 degrees 15 minutes East 62 feet, thence South 83 <br /> degrees 12 minutes West 225.6 feet, thence South parallel with <br /> the east line of said Eugene Avenue, 400 feet, thence South 87 <br /> degrees 42 minutes West 278.5 feet, thence along the east side <br /> of said Avenue 439 feet to the place of beginning, containing <br /> 3.178 acres of land in Section Six (6) Township 18 South Range 3 <br /> West, in said Lane County, Oregon" <br /> and <br /> ~HEREAS~ the City of Eugene has caused the same to be appraised and <br /> determined its value, and <br /> \NHEREAS the Pacific Loan alld Savings Association have offered the <br /> City $5500.00 for said property, which, according to the appraise- <br /> ment is all that the property is worth, <br /> NOV;, THEREFORE, <br />I BE IT RESOLVED by the Common Council of the City of Eugene that <br /> the Mayor and Recorder be and they are hereby directed to execute <br /> and deliver to Pacific Loan and Savings Association a bargain and <br /> sale deed to the above premises, upon payment of the sum of $5500.00, <br /> the purchase price as determined by the city. <br /> Renewal of the airport contract between the city of Eugene and United Air <br /> Lines Transport Corporation, was referred to the Judiciary Committee and City Attorn y <br /> 18 with power to act. <br />I / <br /> The City Recorder presented a statement of the city affairs for the year <br /> (19 ending December 31, 1937. <br /> The Police Committee recommended that no license fee be imposed upon pin and <br /> ball operators until after the co~rici1 meeting of January 10, 1938, at which time <br /> /20 it is believed a supreme court decision 'on the legality of the devices can be expect d. <br /> Communication from the League of Oregon Cities on codification of the city <br /> charter and ordinances, was presented.
