<br />~276 <br /> <br />Communication from the Board of Appeals revealed the request of Tom Shumway <br />asking for a s~ecial permit to enlarge a small building on a fractional lot which <br />L) he owns at 5412' Lawrence Street for 'his own private use as a residence, said build in <br />~;.J to exceed the zoning limitation as to area but to comply with the Building code. <br />~' The Board would recommend that this request be granted, and upon motion made and <br />15liSeconded the recommendation was unanimousfY approved. <br /> <br />The communication" from the' Board of Appeals also presented the request +ro~ <br />C. A. Carlson for a permit to erect an apartment house on his lot at 1458 Pearl <br />Street. This lot is just across the alley from, the R-2 zone but the building would <br />otherwise conform to the zoning ordinance and the Building Code. The Board <br />recommends that this permit be granted and upon motion made and seconded the recomme da- <br />16~tion was unanimously approved. <br /> <br />The communication from the Boar~' of Appeals also revealed the r~quest of <br />Julio W. Silva to erect a twenty foot can9PY on the east side of. the oi~ Knights of <br />Pythias property at the southeast corner of the intersection of Olive Street and <br />Eleventh Avenue. The Board recommends that this request be denied and upon motion <br />17~made and seconded the recommendation of the Boardowas unanimously approved. <br /> <br />The Board of Appeals presented the request of L. L. Dunham asking for a.perm't <br />to erect a duplex residence on the west 50 feet of Lots 7 and 8, Block 11, Hendrick' <br />Amended Addition. This lot, is across the street north of the High School and is one <br />block west of the R-2 zone. Mr. Dunham bought the property with the understanding <br />that it was in the Apartment Zone, had plans drawn and obtainedoapproval for a loan, <br />but was refused a permit by the Building Department. A majority of the members of t <br />Board recornnended that the request be denied. A brief discussion was had on the <br />matter after which Mr. Dunham addressed the council in person'asking f9r a special <br />permit to proceed with the building of the duplex. Motion was then made and seconde <br />1 and approved that a special permit be granted and it was so ordered. <br />o 0 <br /> <br />I <br /> <br />I <br /> <br /> <br />Communication was presented from the Eugene Hardware Company protesting <br />against traffic violation tickets being placed on their delivery trucks behind their <br />store. It was pointed out that some few months ago, permission had been granted to <br />allow tnem to park their delivery, truck at this spot and they requested so~e stateme t <br />that would assure them that there is no musunderstanding. Expression from members <br />of the council was. fairly well divided on the request.and the matter was ordered <br />19--tteferred to the Police Committee for report at the next council meeting., <br /> <br />Communication was presented from J. D. As the app+ication had been <br />approved. by the Chief of Police, motion was made and seconded that the license be <br />22~granted and it was so ordered. <br /> <br />The following curb cut applications were presented and the recommendations <br />of the City Engineer unanimouslyaapproved: N9. 713, Thelma Peckham,v980 Charnelton <br />Street for a parking lot at Stanleys Store, (approved) ; No. 714, W. B. Frink~65 <br />West Sixth Avenue, the Engineer recommends that this cut be granted with two <br />provisions, that the cut east of this one be closed four feet, that provision be <br />made so that the backing of ~ars onto Sixth Avenue be prohibited, recommendatio~ <br />23 approved; and No. 715, J. _0. Eane~, 1253 West 12th Avenue, (approved). <br /> <br />The City Recorder reported that through an error in the listing of the <br />1940 license plates on traffic tickets, Mr. N. H. Comish had paid for a traffic <br />violation which in reality was the violatiqn of another person. It was discQve~ed <br />that the license number in question was a 1939 license and not a 1940 license. <br />The Recorder requested that the $1.00 be refunded to Mr. Comi~h and "upon motion <br />made and seconded the refund was unanimously approved and the Recorder instructed <br />24~to include the bill with the January bills. <br /> <br />I <br /> <br />. - . <br />A resolution was presented stating that the City of Eugene does not wis4 to <br />continue the present haphazard method of guaranty and will, after.January 1, 1941 <br />and shall discontinue the present policy of rural fire protection; it shall recogniz <br />only contracts with regularly organized fire districts for outside fire protection <br />25~and upon motion made and seconded the resolution was unanimously approved. <br /> <br />I <br /> <br />RES 0 L UTI 0 N <br /> <br />VrnEREAS, the City of Eugene as a temporary expedient <br />has been accepting bonds and insurance policies as a ~eans of <br />guaranty for the costs incurred by the city in going to fires <br />outside of the city limits with the city's fire equip- <br /> <br />ment, and <br /> <br />WHEREAS, the Legislature of the State of Oregon has made <br />( <br /> <br />~ <br />
