Councilmen present were: Pennington, Bond, Farrington, <br />~<t) <br />~ Koppe, Barette, and Hawn and Stewart; absent, Browson.. <br /> The minu~es of' the previous meeting were read and ordered placed on file, <br />2 and the meeting herewith called to order. <br /> Walter S. Garrett addressed the council in regard'to a special set-back <br /> for a garage at his new home at 23rd and Lincoln. The garage was to be under the <br /> house and the entrance to the garage was to be on .Lincoln Street. The regular I <br /> set-back as designated by the building inspector did not give him enough room <br /> and he asked the council if he might be permitted to extend the. garage out four <br /> feet farther than the set-back designated by the building inspector. This would <br /> place the garage about 11 feet from the lot line. Mr. Garrett explained that he <br /> owned a strip of ground 75 feet on 23rd and running back North 180 feet on Lincoln <br /> Street. There was no sidewalk North of 23rd on Lincoln and, he did not believe <br /> that there would ever be a sidewalk placed there. Councilman Barette tnought <br /> the council should not be too hasty in granting this request and added it was not <br /> a good plan to make the change tonight. After some discussion by the council, a <br /> motion was made by Hawn and seconded by Pennington that the City waive the set- <br /> back as established by the building inspector and allow Mr. Garrett to build out <br /> the extra four feet as requested. Motion was carried with all councilmen present <br />3 except Barette voting aye. <br /> Councilman Koppe reported on the sidewalk for Mrs. Mary Ruth Campbell at <br /> 284 Pearl Street, that hadtbeenreferred to him from last meeting. He said it <br /> was the Judiciary Committee's report that Mrs. Campbell. may have made some repairs <br /> on the sidewalk but that she had not cut out the roots to the tree that was causimg <br /> the trouble. The Committee thought the City was justified in doing this work and <br /> cutting the roots of the tree. A motion was made, seconded and carried that the <br />4 report of the Judiciary Committee be adopted. <br /> Attorney Calkins reporting for the Judiciary Committee in regard to the <br /> application of Chet Lawson for a Cottage Grocery in Kincaid Park Addition, stated I <br /> that he had looked up the law on this matter and he believed that the Planning <br /> Commission and the Council would not be allowed to over-rule the restrictions <br /> that were placed in the deeds in this tract. He said that in some cases courts, <br /> had ruled otherwise but that their ruling would not hold in this case. A motion <br /> was made by Bond and seconded by Stewart that the recommendation of the Judiciary <br /> Committee and City Attorney be carried out and that the building inspector should <br />5 not allow a permit for the. construction of this grocery store. <br /> A counter offer of $425.00 was made by the Finance Committee on the <br /> offer of T. H. Gredvig of $350.00 cash for Lot 10, Block 2, Hollenbeck Addition <br /> kN.W. corner of 14th and WaShington). Upon motion made and seconded this counter <br />6 offer was accepted by the council. <br /> The Finance Committee accepted the offer of R. C. White of $400.00, $80.00 <br /> cash and the balance at $8.00 or more per month plus interest at 6% for Lot 8, <br /> Block 3, Pearl Addition. Upon motion made and seconded this offer was accepted <br />7 by the council. <br /> ! <br /> The offer of M. S. Barker Df $700.00, $140.00 cash and the balance at <br /> $140.00 per year plus interest at 6% for the West 110 feet of Lot 10, Block 5, <br /> Kelsay's 2nd Addition, was accepted by the Finance Committee. Upon motion made <br />8 and seconded this was accepted by the council. <br /> * counter offer of $500.00 was given by the Finance Committee on the offer <br /> of C~ H. Cooper of $450.00 cash for the East 60 feet of Lots 7 and 8, Block 23, I <br /> Gross Addition. Upon motion made and seconded this counter offer was accepted by <br />9 the council. <br /> The offer of M. S. Barker of $1,000.00, $200.00 cash and the balafice at <br /> $200.00 per year plus interest at 6% for the North 90 feet of Lot 6, Block 2, <br /> R. F. Scott's Addition was accepted; subject to encroachment of the house on the <br /> south side of the property. Upon motion made and seconded this offer was accepted <br />10 by the'council. <br /> The offer of F. R. Robinson of $100.00 for the North 50 feet of Lot 3, I <br /> Block 1, McCully's Additioh was accepted by the Finance Committee. Upon motion <br />11 made and seconded this offer was accepted by the council. <br /> A counter offer of $500.00 with $25.00 refundable if construction is <br /> started within ninety days was presented by the Finance Committee on the offer of <br /> Arthur Riehl of $450.00 cash for the South 90.9 feet of the West 63 feet of Lot <br /> 3, Block 17, Fairmount Addition. Upon motion made and seconded this counter offer <br />12 was accepted by the council. / <br /> The offer of Herbert L. Large of $750.00 cash for the West 60 feet of <br /> I <br /> I <br />~ Lot 3, Block 23, Fairmount Addition was accepted. Upon motion made and seconded <br />
