All other employees must be residents and inhabitants <br />I of the City at the time of their appointment and during the tenure of thier office <br />:;::~ except as specially provided by the- Counc il. <br />~, <br /> <br />I <br /> <br />Section 5. <br /> <br />Vacancies shall be filled in the same manner as the original <br />appointment. <br /> <br />Section 6. The office of Chief of Police and Chief of the Fire Department <br />are expressly removed from Civil Service. The present incumbents may elects to <br />resign as department heads, retain such seniority as the Civil Service Commision <br />shall determine, and remain under Civil Service. <br /> <br />Section 7. The duties of all employees shall be assigned to them by the <br />City Manager and they shall be responsible and accountable to the City Manager. <br /> <br />Section 8. The powers herein granted to the City Manager shall be sole and <br />exclusive. <br /> <br />Section 9. The City Manager may be removed with or without cause at any time <br />by the Cornmon Council, after six months tenure. <br /> <br />Section 10. The Eugene Water Board and the Eugene Library Board and their <br />respective employees are expressly excluded from the operatdon of this act. <br /> <br />Section 11. Other than as provided herein, the Mayor and Council shall <br />retain the powers granted in Section 3 of Chapter 11 of the Charter. <br /> <br />Section 12. This act shall take effect as to the levy provided immediately <br />upon its adoption by the electors; and as to all other provisions of the act of <br />January 1, 1945. <br /> <br />Section 13. All acts and parts of Acts in conflict herewith are hereby <br />repealed. <br /> <br />Section 14. The Comrnon Council is hereby authorised and directed in addition <br />to existing levies to, in each year, levy, assess and collect a tax not to exceed <br />one mill upon the assessed valuation of all property in the City not exempt from <br />taxation; which tax shall be in addition to and in excess of the six percent <br />constitutional limitation upon the City Tax levy and shall be used in support <br />of the City's domestic budget. . <br /> <br />I <br /> <br /> <br />, . <br /> <br />3 <br /> <br />Councilman Farrington stated that in order to get the proposal before the <br />Council he would move that the resolution be adopted and that the Charter &TIend- <br />ment be referred to the people. This motion was seconded by Councilman Hawn. <br />Councilman Hawn stated that while it was not included in the motion it was the <br />request of the cOITilllittee that this be put on the May~rprimaries. Councilman Crum- <br />baker stated he thought there were some changes that should be made in the propos d <br />act and in the text of the proposal which was a part of the act. He stated that <br />he did not know whether the Council would be favorable to an amendment but that <br />at this time he would distribute to the Council copies of an amendment which he <br />would recommend. This amendment was concerning Section 1 of the proposed draft <br />prepared by the charter committee on February 14th and again on February 18th mn <br />which the Cornmittee recommended that the appointing power be in the Council <br />instead of the Mayor. <br /> <br />, <br />, <br />'\ <br /> <br />Councilman Crumbaker at this time recommended the proposed amendment which <br />was as follows: <br /> <br />TO STRIKE OUT ALL OF SECTION ONE IN THE PROPOSED AMENDNrENT Al\lD SUBSTITUTE <br />THE FOLLOVJING: <br /> <br />Section 1. (a). That the Common Council'of the City of Eugene is hereby <br />authorized and enpowered and directed to appoint a City Managernl as administra- <br />tive officer, and to appoint a municip81 judge as the judiccial officer of the <br />City and to fix'their respective salaries and terms of office. <br /> <br />~b), If the Council fails to agree upon a candidate for the office of City,] <br />Manager, so that the office shall be vacant for a period of two weeks, then in <br />that event the Mayor shall be enpowered to appoint a manager pro tem who shall <br />serve as City Manager; provided that the manager pro tem shall not have power <br />to appoint or to dismiss officers or employees of the City except wit~ the <br />approval of the City Council provided further that the manager pro tem shall <br />hold office only until a city manager shall have been agreed upon, in no event <br />a longer period of time than six months, provided further that the manager pro <br />tem, shall not be eligible for re?ppointment to the offife of manager pro tem, <br />for a appointment for the office of City Manager. <br /> <br />I <br /> <br />~ <br />
