(C). The manager shall be administrative head of the City governement, He <br />shall be chosen by the Council without regard to political consideration and <br />soley with reference to his executive and administrative qualification. <br /> <br />~ <br /> <br />(d). The manager and such other officers of the City as may be designated <br />by a vote of the Council shall be entitled to seats with the Council, but shall <br />not have a vote therein. The Manager shall have the right to take part in the <br />discussion of all matters coming before the Council. <br /> <br />,!*~ <br />."-'!f" <br /> <br />~, <br />":'4., <br /> <br />(e). No member of the Council shall in any manner, directly or indirectly <br />by suggestion or otherwise attempt to influence or coerce the manager in the <br />makine of any appointment or any removal, or in the purchase of supplies, nor <br />shall any member of the Council exact any promise relative to any appointment from <br />any cnadidate for manager of discuss, directly or indirectly with any such <br />r cnadidate, the matter of appointment to any city office or employments. Any <br />~ violation of the foregoing provisions of this section shall work a forfieture of <br />"i:.' the office of the offending member of the Council who may be removed therefrom by <br />, the Councilor any court of competent jurisdiction. Nothing contained herein, <br />: however, shall be construed as prohibiting the Council, while in ipen session <br />from discussing with or suggesting to the manager anything pertaining to City <br />affairs. <br /> <br />Councilman Crumbaker made some further remarks regarding the proposed <br />amendment and made a motion that the ,Council adipt the proposed amendment as <br />presented above. This motion was seconded by Stewart. Councilman Hawn stated <br />that he was not so much concerned about who should make the appointments as l8ng <br />as the appointment would be confirmed by the Council and that the Council was to <br />set the salaries. He stated that he was not favorably impressed by the fact that <br />other cities had decided to have the Council make the appointment rather than the <br />Mayor. He stated that he thought Section "E" in the amendment proposed by Douncil- <br />man Drumbaker had merit but ~ould be impractical to enforce. Councilman Davis <br />stated that regarding Section "E" he felt that a manaGer VJould be glad to consult <br />with the councilmen regarding appointments and that he was not favorable to this <br />section. <br /> <br />Mrs. C. B. Swango, President of the Lane County League of Women Voters, <br />stated that the League felt there would be some changes in section one of the <br />proposed alrrandment and that section 9 and 14 should be left out. <br /> <br />Mr. A. C. Dixon stated that he felt there were 3 or 4 sections that might <br />be changed. One was that he felt that appointment should be made by the Council <br />in place of the Iv,ayor. That he was in favor of section HEll in the proposed <br />amendment and that he felt that the six months tenure referred to in section 9 <br />regarding the removal of the City Manager was simply a danger sign to the proposed <br />manager. He stated he felt that it would be more satisfactory if the six months <br />tenure was left out of section 9. He stated that he objected to the one mill tax <br />levy rider as provided in section 14. <br /> <br />Mr. James A. Rodman stated that the Committee had discussed that and'that <br />there was ample precedent for this mill levy and that he felt that theywere only <br />making a mountain out of a m~le hill regarding whether appointments should be <br />made @y the Mayor or the Council as lonG as the Council confirmed the appointments. <br />Councilman Ha~n explained that there was a 5 mill limitation in the Charter for the <br />General Fund. That this was not sufficient for the requirements of the general <br />fund and a proposed changed in this 5 mill levy ahd been voted down three tinles by <br />the people. That the Co~~ittee had discussed at length the advisability of includi g <br />this with the manager amendnlent. The co@nittee was convinced there was need for <br />the extra funds and had recommended that it be included with the manager amendment. <br /> <br />Ed Boehnke, as a member of the Comrdttee stated that he felt that one mill <br />levy should not be put on with the proposed manager form as he felt that the 6% <br />limitation was much more flexible than the one mill levy. <br /> <br />Colonel Tierney stated that he had been waiting for the past 15 years for <br />this charter amendment providing for a,City ~~nager and that he thought this was <br />qn excellent start and th~t he felt that the matter should be left open now for the <br />people to consider and hearing held and suggestions for changes be heard. <br /> <br />Christian Jensen, representing the Brotherhood of Local Trainmen stated that <br />he felt this matter should be left open for further consideration as it had only <br />been given to the press on Sunday~ He said that he had head pbjections from not <br />only labor but f~om several business men regarding the removal of the Chiefs of <br />the Police and Fire Department from Civil service and that the Railroad Unions <br />would like to have time to have a meeting to consid~ such changes as they might <br />wish to make to the proposed amendment. <br /> <br />~ <br />
