He <br /> I <br /> thought Mr. Mohr's suggestion was very good, and requested that he bring a letter to <br /> the Council for consideration. Councilman Williams thought the point was well taken. <br /> Mrs. Hayward moved seconded by Mr. McDonald to file Items 1,2 & 3 of the Committee Report. Motion carried. <br /> I 4. Laurel Hill Area Petition - Eugene Planning Commission granted site approval for a 92 I <br /> unit apartment development on property' long zoned commercial. Manager .read a petition I <br /> ! signed by 293 residents of the Laurel Hill area requesting postponement of all construction, i <br /> other than single family, until residents of the neighborhood and the Planning Commission <br /> develop a comprehensive growth plan for the neighborhood. <br /> A memo was distributed which had been prepared by the Planning Director and City Attorney I <br /> explaining development permitted under theZoning Ordinance, and the probability of <br /> e postponement of other conditional uses, as requested by the citizens group. <br /> The Planning Director described this as an area of long narrow lots, not suitable for <br /> modern needs. He explained that the Conditional Use procedure was used to exchange <br /> density, and th?t the appeal time had expired before residents filed an objection. <br /> Mayor Anderson asked that discussion be confined to the q~estion of whether or not to <br /> I proceed with a public hearing, rather than trying to resolve problems at this point. <br /> The City Attorney commented that, under the City Zoning Ordinance, the legal time limit <br /> for an appeal had expired. If the Council wished a public hearing, it would have to be <br /> on some other basis. <br /> In answer to Mr. Louis Durchanek, Planning Director said notification and appeal period <br /> are the same for Planned Unit Development or Conditional Use Permit. Mr. Durchanek <br /> could not see why conditional use was required under zoning regulations. Planning <br /> Director explained by using conditional use permit, RG density and commercial service <br /> were obtained on RA zoned property. These are transferred to the Planned Unit Develop- <br /> ment, since that procedure is more stringent. <br /> There was further discussion of appeal procedures and notification required. <br /> Mr. Jim Bartell, chairman of the Committee, said the petition made it clear that they <br /> wished to have a hearing., <br /> Mrs. Hayward suggested setting a time for discussion at a committee meeting. City Manager <br /> felt an evening meeting would be a more convenient time for petitioners. <br /> r Mr. George McGinnis said the main consideration was that a public meeting be held where <br /> I <br /> I they can establish a framework of discussion .at which these points may be handled. <br /> I Councilman Mohr asked if it was understood, that a public hearing could be held about <br /> development of the entire area, but in the judgment of city administration there was <br /> no way to prevent the start of construction on the development already granted approval. <br /> counci~woman Beal suggested ,a joint Council-Planning Commission meeting. Mr. McGinnis <br /> said/t is could be incorporated 'into the overall framework, this would be fine. <br /> , , <br /> Mr. Bartell 'said the committee 'was not concerned necessarily about the 92 unit d'evelopment, I <br /> but that the total character and complexion of the area were not changed. He agreed a <br /> - joint meeting might be desirable. <br /> Mayor Anderson suggested that this matter be heard at the meeting of December 8. Citizens <br /> of Laurel Hill agreed that this would be convenient. <br /> I, Mrs. Hayward moved seconded by Mr. McDonald to hold a public hearing Monday, December 8, <br /> I 1969 at 7:30 p.m. in the City Council Chambers regarding development of Laurel Hill area. <br /> I <br /> In answer to Mrs. Beal's suggestion that the motion be amended 'to include the Planning Com- <br /> mission, Mayor Anderson said it was not necessary to invite them - they are always 'welcome. <br /> Vote taken on motion, and motion carried. <br /> Mr. Louis Durchanek, 1760 Sylvan, said he was a member of Laurel Hill Citizens Committee and explained <br /> tha t , in the absence of Mr. Bartell, he would act as chairman. The committee was requesting that a <br /> plan be decided upon and adhered to for the Laurel Hill neighborhood. He said members of the committee <br /> I have not accepted the proposed Planned Unit Development for their neighborhood as an accomplished fact, <br /> and hope it will become evident this plan is inappropriate for the Laurel Hill neighborhood. <br /> I Mr. <br /> Sid Armstrong, 2640 McMillan Street, asked that the Council impose a complete moratorium on buiJd- <br /> ing in the Laurel Hill area. He asked for clarification of Planning Commission procedure, and cited <br /> the General Plan for 1990 as setting aside this area for low density building. He felt this was a <br /> unique valley, and wanted to keep it that way. <br /> - I Mr. Durchanek spoke on community attitudes a.nd property rights.
