Motion carried. <br /> , <br /> i <br /> IV. Petition, Balboa Drag Strip - A petition was received which requested closure of Balboa <br /> Drag Strip. Reasons given are excessive noise, smoke, dust and litter. It has long been <br /> recotnized that operation of Balboa Drag Strip has been a problem to residents of the <br /> area, but the advantages of having such an outlet have also been recognized. It is <br /> suggested staff study and report on the problems and advantages of the operation. <br /> The City Attorney said the city receives a multitude of complaints regarding the <br />e operation continuing after 10:00 p.m. This is the biggest problem with the drag strip. <br /> :i Dr. Purdy was not sure this matter should come before the Council. He felt staff <br /> could work with the operators to solve the problem. He felt the community needed <br /> this type operation. <br /> Mayor Anderson said the Council should acknowledge receipt of the petition. <br />I Mrs. Hayward moved seconded by Mr. Gribskov to acknowledge receipt of this petition, <br /> and direct staff to bring back a report for further consideration. Motion carried. <br /> Mr. McDonald moved seconded by Mr. Teague to approve Item IV of the Committee report. <br /> i <br /> Councilman McDonald said this item had been before the Council approximately one year ago. He felt <br /> the problem was that the noise did not cease before 10:00 p.m., and felt perhaps staff investigation <br /> il could solve the problems. <br /> .' Vote taken on motion as stated. Motion carried. <br /> I <br /> , V. Assessment Deferral - Two requests have been made for deferred assessment in the Crest <br /> Heights area. The City is requesting easements for sewer construction and parts of both <br /> properties qualify for deferral. Properties and assessment to be deferred are: <br /> Roland W. Eberhardt, 949 Crest Drive - $4,981.35 <br /> Eugene Development Center, 2121 Franklin Boulevard - $8,051 <br /> Mrs. Hayward moved seconded by Mr. Gribskov to approve this request. Motion carried. <br /> Mr. McDonald moved seconded by Mr. Teague to approve Item V of the Committee r~port. Rollcall vote. <br /> I All councilmen present voting aye, the motion carried. <br /> " VI. Oregon Municipal Policy Statement - The League of Oregon Cities has developed <br />I " <br /> guidelines to reflect a unified policy position of the cities of Oregon. The City <br /> Council has been invited to discuss and submit suggestions for revision at the meeting <br /> of November :l0. <br /> Councilman Williams was concerned with a statement regarding jury trial in municipal <br /> courts. He 'felt it might be well to leave the door open for other techniques. Mr. <br /> Mohr was surprised at the policy statement, believing it did not reflect the ree- <br /> I commendations of the Governor's committee on courts. The City Attorney was con- <br /> I <br />e " cerned the municipal courts would be greatly overloaded with jury cases and would <br /> I not be capable of handling them. <br /> Councilman Mohr recommended a statement on court system to square with the recommen- <br /> dation of the Governor's committee on court reform. The municipal court should be <br /> " de-emphasized as a function of the city and should be phased out. <br /> Personnel - Mr. Mohr did not think the League policy was in line with the city <br /> policies and city legislation. Councilman Williams did,not think a higher authority <br /> should tell cities what they should do. The City Manager saw no conflict between this <br /> statement and the way the city of Eugene had proceeded. A system for cities is <br /> provided, but they have a choice whether they wish to go this way. <br /> Housing - Councilman Williams was concerned with the statement "the administration <br /> should establish a realistic housing goal...." He felt there was absolutely no doubt <br />I about the need for public housing, and he could see no reason to lower the goals 'in <br /> face 'of the need. Ci ty Manager suggested the wording be changed to Hmaintain." <br /> Mayor Anderson said the policy is set up to inspire and encourage smaller communities <br /> to provide for programs and efforts of their own. This is an educational document <br /> for all municipalities. There will be an opportunity at the convention to speak on it. <br /> There was a discussion regarding the role of the voting member of the City Council. <br /> The consensus was that this issue couid be decided at the meeting. <br />e <br /> 10/12/70 - 3 <br /> .... <br />
