' . <br /> <br />Vote was taken on the motion as s.~atet:!._ Mot.~_o.nc:~r!..i_e~___~~ilf!O_~l.y~..__ __ <br /> <br />Council Bill No. 151 - Amending Section 5.990 of City Code and adding Section 5.285 <br />re: Off-s~reet Parking of Motor Vehicles, was submitted and read the first time by council <br />bill number and title only, there being no councilman present requesting that. it be read in full. <br /> <br />Assistant Manager reviewed purpose for the proposed ordinance and advised that City Attorney <br />gave the opinion that the ordinance would apply on any City operated parking lot where an agent <br />is placed for management such as Diamond Parking. It applies to all City-controlled unmetered <br />parking lots and would extend the remedy of the "boot." <br /> <br />Councilman Hershner said he did not foresee its application to the 10th and Oak Overpark and <br />wondered wh~ther the "boot" would be used for "overtime" violations. Assistant Manager re- <br />plied that it is felt use of the "boot" would be less expensive to the violator then towing <br />expense. Its use will be controlled; unpaid fees or unpaid parking tickets will be verified <br />to show there is in fact a violation of ordinances. Primary need for use of the "boot" is in <br />those instances where permit fees for parR:ing on City lots have not been paid for an extended <br />period of time: In answer to Mrs. Beal, Assistant Manager said there is legislation already <br />in existence to allow use of the "boot" on metered lots. <br /> <br />Councilwoman Campbell asked if the ordinance spells out length of time a car is parked before <br />it can be booted. Assistant Manager replied that this ordinance provides only that a car can <br />be booted if there are unpaid permit charges, outstanding citations, or unpaid fines. <br /> <br />Mrs. Beal moved seconded by ,M~. W,illiams that the, bill be re.adthe. .second time by <br />council bill number only', with unanimous consent of the Council, and that enact- <br />ment be considered at this time. Motion carried unanimously and the bill was read <br />the second time by council bill number only. <br /> <br />Mrs. Beal moved seconded by Mr. Williams that the bill be approved and given final <br />passage. Rollcall vote. All councilmen present voting aye, the bill was declared <br />passed and numbered i6687. <br /> <br />C ..RezQning Recommended by, Planning Commission December 12, 1972 <br /> <br />1. Rezone from R-l to RG area on northwest corner ofl7th 'and Chambers (Cedar Lane <br />Company) - Applicant originally requested RP ZOnilJg on properties now zoned RG <br />and R-l. Planning Commission recommended rezoning the R-l portion to RG and <br />leaving all as Garden Apartment Residential District. <br /> <br />Planning Director noted history of controversy in this area when the existing <br />clinic was allowed. Commission was concerned about spread of commercially-zoned <br />property and the fact that the RP zone would allow many types of professional <br />offices and certain commercial uses not compatible with the neighborhood. Planning Director said the Commission feels C-2 on 11th to R-2 on 12th <br />to lesser density farther south are appropriate uses for this area for some time. <br />There is no specific plan to rezone additional property in that area.
