He stated that Assistant <br />City Manager David Whitlow and City Attorney Keith Martin were present to answer <br />any questions of council regarding the issue. <br /> <br />CB 2747--An ordinance concerning animal euthanasia; amending <br />Section 4.450 of the Eugene Code, 1971; and declaring an <br />emergency. <br /> <br />Mr. Obie moved, seconded by Ms. Smith, that the bill be read the <br />second time by council bill number only, with unanimous consent of <br />the Council, and that enactment be considered at this time. Roll <br />call vote; the motion carried unanimously, 6:0. <br /> <br />Council Bill 2747 was read the second time by council bill number only. <br /> <br />Mr. Obie moved, seconded by Ms. Smith, that the bill be approved <br />and given final passage. Roll call vote; all councilors present <br />voting aye, the bill was declared passed (and became Ordinance No. <br />19251) . <br /> <br />e <br /> <br />VII. ORDINANCE CONCERNING MUNICIPAL COURT POWERS (memo, ordinance distributed) <br /> <br />City Manager Micheal Gleason introduced the agenda item. City Attorney Keith <br />Martin presented the staff report, reviewing his May 24, 1984, memorandum to the <br />City Manager. He explained that the intent of the proposed ordinance was to <br />clarify that the Municipal Court may establish a schedule of fines, forfeitures, <br />bail and security deposits required of individuals violating the City Code. He <br />said the other changes in the proposed ordinance would shift previous Code <br />language with regard to the power of the judge to cite individuals for contempt <br />of court from the section covering powers of the court to the offenses section. <br />He added that the Penalties section was also reordered and clarified to be more <br />consi stent wi th the rest of the Code. <br /> <br />Councilor Holmer, referring to the draft ordinance, asked if it was possible to <br />eliminate the necessity of the emergency clause in an ordinance. Mr. Martin <br />said it could be eliminated if the council wished to wait 30 days before every <br />ordinance became operative. He explained that the clause made an ordinance <br />operative as soon as it was passed by the council. Mr. Holmer asked why all <br />ordinances could not become immediately operative.
